Council Minutes of 3/15/2lli?5 <br />motion was seconded by Councilman Dailey. Roll call: Gareau, yes, with comment that <br />~~, <br />he had voted no on the first motion but was now voting yes. There is a time in the career <br />as a political official where you have a personal opinion on something but it must be <br />weighed against what you believe to be the best interest of the con7tnunity at large. He <br />struggled with this particular issue because he has fundamental disbeliefs with the <br />principles that are in this particular piece of legislation. He carriead through with those <br />personal opinions when he cast his first vote. The result of that was the fact the <br />legislation would not pass under suspension, and it would jeopardize an agreement with <br />AFSCME. By jeopardizing an agreement with AFSCME, it could j~pardize the overall <br />relationship with AFSCME and the city. He does not believe that his individual interest <br />and opinions are worth that type of a problem. This is one of those rare occasions where <br />you have to sit back and take what you personally believe, put it wide and do what you <br />believe to be in the best interest of the city, even though you don't entirely agree with it. <br />That is why he is switching his vote and voting yes. Roll call continued: Dailey, yes; <br />Nashar, yes; Miller, yes, with explanation. It is his understanding that all the RTA <br />related issues would hopefully be able to go to three readings so that nothing appeared to <br />be rushed. In light of the fact that it appears this legislation will pass this evening and <br />that there will not be three readings, he will vote yes. Roll call continued: McKay, yes; <br />Limpert, yes; Kasler, yes. The motion for suspension of the rules passed unanimously. <br />Councilman Gareau moved for adoption, and the motion was seconded by Councilman <br />Dailey. Roll call: Gareau, yes, with the comment that he would dimply incorporate the <br />opinion expressed a moment ago in his other vote related to this piece of legislation into <br />this vote. Roll call continued: Dailey, yes; McKay, yes; Limpert, yes, based an the <br />comments and recommendations of the Law Director. Roll call continued: Kasler, yes; <br />Miller, yes; Nashar, no, commenting that this will only benefit three employees and he <br />does not feel it is fair to the rest of the employees. The motion passed with six yes votes <br />and one no vote. Ordinance No. 2005-23 adopted. <br />Ordinance No. 2005-24 was introduced and placed on first reading;by Mayor Musial. An <br />ordinance amending Section 177.02 of Chapter 177 (Community Access) of the <br />Administrative Code, entitled "Purpose," to reflect the change in the city's website <br />address. Councilman Limpert moved for suspension of the rules requiring three readings <br />and committee review. The motion was seconded by Councilman Gareau. Roll call: <br />Limpert, yes; Gareau, yes; Kasler, yes; McKay, yes; Miller, yes, vwith the hope that some <br />other clean-up issues related to this can be brought back to cornrhittee for review. Roll <br />call continued: Nashar, yes; Dailey, yes. The motion passed !unanimously. Dennis <br />Lambert, 25057 Carey Lane, suggested the legislation be amended to remove the website <br />address so it would not have to be amended in the future. Law Director Dubelko said he <br />believed there are some benefits to having in the legislation reference to the city website <br />that people in the public who look at the ordinance can identify: Councilman Limpert <br />moved for adoption. The motion was seconded by Councilman Gareau and passed <br />unanimously. Ordinance No. 2005-24 adopted. <br />Ordinance No. 2005-25 was introduced and placed on first reading by Councilman <br />Gareau.
