Council Minutes of 12/19/2006 <br />Planning and Design Commission, where significant discussion took place as to <br />the plant substitutions proposed. Based on the Commission's recommendations, <br />the applicant made a number of adjustments to the plans which were deemed <br />appropriate. There was little discussion on the substitution of plant materials and <br />additional materials. The discussion turned to the condition of the parcel on the <br />north side of the fence. Availabili#y and in the field deviations were key issues. <br />The committee turned to the condition of the fence on the north side. Mr. <br />Orlowski has worked with residents to clean up the area. Mr. Taft and the <br />committee agreed as follows: By two motions: the committee unanimously <br />recommended approval subject to the recommendations of Planning & Design <br />and further subject to the requirement that applicant clean debris along the entire <br />perimeter: debris is as follows: dead trees, stumps, branches on the ground, man <br />made materials, of any sort, vines (killed but not removed, poison ivy or grape) <br />and such removal shall be completed to the satisfaction of Bldg. by May 15. Any <br />further accumulation of debris shall be subject to property maintenance and not <br />subject to enforcement under this section. Councilman Gareau moved to approve <br />the proposed amendment to approved landscape plans for North Olmsted Town <br />Center, 24642-25174 Brookpark Road, subject to the recommendations of <br />Planning & Design Commission and further subject to the requirement that the <br />applicant clean debris along the entire perimeter, debris is as follows: dead trees, <br />stumps, branches on the ground, man-made materials of any sort, vines (killed but <br />not removed, poison ivy or grape) and such removal shall be completed to the <br />satisfaction of the Building Dept. by May 15; any further accumulation of debris <br />shall be subject to property maintenance and not subject to enforcement under this <br />section. The motion was seconded by Councilman Orlowski and passed <br />unanimously. <br />• Ordinance 2006-162. Mr. Burns and Mr. Tom Lee spoke to the issues and <br />expressed opinions as to the (1) need (Mr. Burns) or (2) potential for hardship <br />(Mr. Lee). The ordinance creates a more rigid procedure for Conditional Uses. It <br />deals with how to apply; it changes the hearing procedure notice; it enhances <br />criteria and standards (with approval with Zoning Committee). It sets special <br />conditions and standards for particular conditional uses ( vehicle repair <br />establishments) including wholly enclosed structures being used, storage in <br />building or screening, etc.), expiration of approval if no action and even <br />revocation for the conditional use permit, after notice and hearing before Council. <br />The committee recommended the version approved by the Planning and Design <br />Commission with the exception that 1118.06(F) "discretionary permit" changed to <br />"conditional use permit." The committee unanimously recommended approval of <br />Ordinance 2006-162 as amended. Councilman Gareau made a motion to amend <br />Ordinance 2006-162 as recommended by the BZD Committee. The motion was <br />seconded by Councilman Miller and passed unanimously. Ordinance 2006-162 is <br />amended. <br />• Ordinance 2005-165, legislation which amends Chapter 149 of the Administrative <br />Code ("Planning Commission"), repeals Chapter 1125 of the Zoning Code <br />("Architectural Review Board"), and amends Chapter 1126 of the Zoning Code <br />"Commercial and Other Building Permits"), in order to effectuate the affirmative <br />4 <br />
