Council Minutes of 12/19/2Q06 <br />• Ordinance 2006-194, an ordinance amending section 141.09 of the Administrative <br />Code, entitled "Administrative Motor Vehicle Pool" in order to increase the <br />number of motor vehicles in the Administrative Motor Vehicle Pool from. three to <br />four. The Chair explained that at the last committee meeting, some members of <br />Council had said that they objected to the language of the ordinance which states <br />that the additional car being added to the car pool would be strictly for the <br />Community Life Services Director. Therefore, Mrs. Jones made an amendment to <br />the ordinance striking the first "Whereas" clause, which would remove this <br />language. Mr. Barker seconded the motion.. The committee approved the <br />amendment with a vote of 2-1. Council Member Dailey Jones made a motion to <br />amend Ordinance 2006-194. The motion was seconded by Councilman Barker <br />and passed unanimously. Ordinance 2006-194 is amended. During the committee <br />meeting, Mr. Ryan questioned why the City even. has two separate motor pools of <br />cars, that the Administration should have one general motor pool to oversee and <br />that this is strictly an administrative responsibility. The Mayor replied by giving a <br />brief history of how this legislation came into being, stating that it was punitive in <br />nature, and that the Administration is living within the constraints of the <br />legislation. Mr. Barker stated that he believes a good reason. to have two separate <br />car pools is that then. there is always a clean car available for one of the Directors <br />to use if they have to escort someone around the city. IV1r. Limpert replied that <br />that is a concern., and to try and cut down on the number of cars that need to <br />constantly be cleaned they try and assign cars to specific people. A discussion <br />regarding the need to two car pools continued, with the committee discussing the <br />need to bring forward legislation to eliminate an Administrative car pool so that <br />the committee could further investigate the matter. The Mayor stated that he <br />would bring forward information regarding the history of the two car pools for the <br />committee to review. During the committee meeting, a motion. was made by Mr. <br />Barker to recommend approval of Ordinance No. 2006-194 as amended; the <br />motion was seconded by Mrs. Jones. That motion passed 2-1, with Councilman <br />Ryan. casting the no vote. A motion was then made by Mr. Barker to recommend <br />Council pass this legislation under suspension of the rule. The motion was <br />seconded by Mrs. J-ones and passed unanimously. <br />AUDIENCE PARTICIPATIt,~N <br />Donald Pangrac, 23470 Sharon Drive, asked about the financial information regarding <br />the Rocky River Court for the past several years. Finance Director Copfer explained <br />there is a lawsuit pending against the court, and we are not going to look into that right <br />now. The fine money is down in the court, and they are running very close to break- <br />even. We will not know about the possibility of a deficit until the end of the year. Law <br />Director Dubelko said the lawsuit concerned the State of Ohio, but it may impact the <br />Rocky River Court. Several courts have been illegally collecting court costs. It remains <br />to be seen what remedy will occur. A lengthy discussion ensued about the issue with <br />Law Director Dubelko commenting that, if Council is interested, he will look into it and <br />report on it during a future executive session. On another matters Mr. Pangrac said six <br />years ago his wife had a heart attack, and the quality and speed of ;our service here saved <br />her life. Why would he want to change the service? He wants to see a detailed analysis <br />6 <br />
