Council Minutes of 9/19/2006 <br />reference at the heading or beginning of the section may make it easier for <br />businesses to identify city requirements. Currently, there is some referencing to <br />the Ohio Revised Code and other sections which could be expanded and more <br />inclusive to make the codes more user-friendly for businesses. The committee <br />unanimously voted to hold this issue in committee for further review. <br />• Ordinance 2005-158, an ordinance amending Section 555.03 of Chapter 555 <br />(Noise Control) of the General Offenses Code, entitled "Specific Prohibitions," in <br />order to regulate snow storage operations on commercial property located near <br />residences, as twice amended. This ordinance was briefly discussed, and the <br />committee voted 2-1, with Councilman Barker dissenting, to recommend adoption <br />as twice amended. Councilman Orlowski made a motion that Ordinance 2005- <br />158 be twice amended as per the suggestions of the Law Duector and the <br />recommendation of the committee. Councilman Gareau asked for clarification of <br />the change which came out of committee. Councilman Orlowski answered the <br />change recommended by Mr. Dubelko was: "andlor the addition or removal of <br />materials from such piles or the relocation of such piles, or portions of such <br />piles." This was voted down at a previous Council meeting. It is the same as it <br />was before. (At this point, there still was no second to the motion.) Mayor <br />O'Grady questioned Councilman Orlowski with regard to his report on <br />Ordinances 2006-153 and 2006-154 as he wondered where the amount of $40,000 <br />came from. ($20,000 for each study.) Councilman Orlowski answered that was <br />an approximation given to the committee by Ms. Wenger. Mayor O'Grady <br />requested that be left as a question mark as it is not the position of the <br />administration that it would cost that amount. Councilman Orlowski agreed. <br />President Kennedy asked Councilman Orlowski to repeat his motion as he had <br />missed it. Councilman Orlowski made a motion that Ordinance 2{}05-158 be <br />twice amended as per the suggestions of the Law Director and the <br />recommendation of the committee. The motion was seconded by Councilman <br />Tallon. Councilman Miller asked if the amendments were those high-lighted in <br />gray on the legislation. Councilman Orlowski answered yes, that the amendments <br />were under section L. Councilman Barker asked for clarification as to the reading <br />of the legislation, and it was explained it was on second reading. Law Director <br />Dubelko explained the motion to amend involves the italicized language, nQt the <br />language that's shaded. This is a second amendment, and the shaded areas are the <br />amendment that was previously approved by Council as the first amendment. It is <br />only that italicized language that is involved in this amendment. Councilman <br />Gareau asked for clarification that the time restriction would be 11 p.m. to 6 a.m. <br />Law Director Dubelko said Council had akeady approved that in the first <br />amendment. This motion will twice amend the legislation. The first amendment <br />which was the other language that is set out in the ordinance was already <br />approved by Council. This one will simply include the italicized language, which <br />in essence includes regulation of moving of salt piles also. Roll call: Orlowski, <br />yes; Tallon, yes; Miller, yes; Jones, no; Gareau, no; Barker, no; Ryan, asked for <br />the count and then passed on voting saying Mr. Kennedy can make the decision. <br />Roll call continued: Kennedy, no. The motion failed with three yes votes and four <br />no votes. <br />7 <br />~~ <br />
