Council Minutes of 8/15/2006 <br />John Davis, 5862 Barton Road, again spoke about his belief that he did not receive his <br />just compensation in his final separation pay. He believes the union contract explains <br />what is due him in black and white. He is trying to resolve this matter in the least costly <br />method to him and to taxpayers. <br />Councilman Orlowski said he would like to amend his report, and he made a motion to <br />amend Ordinance ZOOS-1S8 as agreed to at the committee meeting. The mation was <br />seconded by Councilman Miller. Roll call: Orlowski, yes; Miller, yes; Jones, no; <br />Gareau, no; Barker, no; Ryan, yes. President Kennedy broke the tie by voting no. The <br />motion failed. Ordinance 2045-158 is not (twice) amended. (The legislation had been <br />previously amended on S/3/06.) <br />LEGISLATION <br />Ordinance No. 2005-158 introduced by Councilman Orlowski was given a second <br />reading. An ordinance amending Section SSS.03 of Chapter SSS (Noise Control) of the <br />General Offenses Code, entitled "Specific Prohibitions," in order to regulate snow <br />storage operations on commercial property located near residences, as amended. <br />Ordinance No. 2006-137 introduced by Councilman Ryan was given its second reading. <br />An ordinance to make and transfer appropriations for current expenses and other <br />expenditures for the City of North Olmsted for the year ending December 31, 2006. <br />Councilman Ryan moved to table, and the motion was seconded by Councilman Miller. <br />Roll call: Ryan, yes, commenting he was requesting tabling because there may be other <br />alternatives available that can be considered, and this action might be premature. Roll <br />call continued: Miller, yes; Gareau, yes; Jones, yes; Orlowski, yes; Barker, yes. The <br />motion passed unanimously. Ordinance No. 2006-137 tabled. <br />Ordinance No. 2006-I38 introduced by Mayor O'Grady was given its second reading. <br />An ordinance to make and transfer appropriations for current expenses and other <br />expenditures for the City of North Olmsted for the year ending December 31, 2006 as <br />amended. Councilman Gareau moved for suspension of the rule requiring three readings. <br />The motion was seconded by Councilman Miller and passed unanimously. Councilman <br />Gareau moved for adoption. Ordinance No. 2006-138 adopted. <br />Ordinance No. 2006-139 introduced by Mayor O'Grady was given its second reading. <br />An ordinance authorizing the Mayor to consent to a site lease between T-Mobile Central, <br />LLC and Cingular Wireless LLC (FKA AT& T Wireless PCS, Inc.) to collocate on the <br />monopole cellular tower at Clague Park; and further authorizing the Mayor to enter into a <br />ground lease with T-Mobile Central, LLC, to permit additional area for <br />telecommunication equipment, and declaring an emergency. <br />Resolution No. 2006-140 introduced by Mayor O'Grady was given its second reading. A <br />resolution authorizing the Director of Community Life Services to advertise for bids for <br />one (1) new trim and surround flex deck mower for Springvale Golf Course in the City of <br />North Olmsted, Ohio, as detailed in the specifications on file; further authorizing the <br />Mayor to enter into a contract with the Lowest and best bidder for said mower. <br />12 <br />
