Council Minutes of 8/1/2006 <br />conference was held on July 25. The motion to stay the replevin proceedings <br />filed by the city has been granted by the court pending the felony prosecution. <br />• Midwest Claims v. Cruxton, a subrogation case, a case management conference <br />is set for August 3. <br />• C & C Realty case, the appeal of Halleen Chevrolet from a decision of the Board <br />of Zoning Appeals which was affirmed by the Common Pleas Court, is now in <br />the Court of Appeals. The briefing has been completed. There was a conference <br />hearing in the Court of Appeals at which the appellant was offered an opportunity <br />to propose a plan tv settle the case. No plan has been received, so it stands fully <br />briefed ready for decision. <br />• Shelley Company v. the City of North Olmsted is scheduled for mediation on <br />August 10. <br />• Nancy Kovacic v. the city and others, discovery cut-off is at the end of this <br />month and there is a status conference set for August 24. <br />• SERB v. Local IAFF 1267, the city's unfair labor practice against the local fire <br />fighters union, has been transferred to the board for decision. <br />• Krobar liquor transfer objection. The application to transfer ownership of the <br />permit has been withdrawn, which moots our objection to that transfer. <br />5) Attended the HUD Policy Conference in Anaheim, CA the last week of June, the cost <br />of which was paid for with HUD funds. Also attending were the Mayor and Council <br />Member Nicole Dailey Jones, the chair of the Fair Housing Review Board. HUD <br />designated the positions within the city government that it wanted in attendance. It was a <br />very good policy conference. He attended the legal seminar portions of the conference <br />and got a big picture view of how HtID operates its fair housing program and some of the <br />hot issues in fair housing across the country. <br />6) Law Dept. offices have been relocated to what was formerly the Clerk of Council's <br />office and the Community Life Services offices. <br />7) On July 19, attended a meeting at Walter & Haverfield regarding the case assigned to <br />them to negotiate with AT&T on Project Lightspeed. <br />8) On July 20, attended a Fair Housing Review Board, but there was no quorum. <br />9) On July 26, attended a Records Commission meeting. <br />10) Spending time reviewing all the RFP's that have come back for outside counsel in the <br />various areas-telecommunications Iaw, environmental taw, civil litigation, criminal and <br />traffic defense, workers' comp and labor law. He is prepared to make a presentation to <br />Board of Control next week on all except for labor, which he will hold back tv wait for <br />the Mayor's labor negotiator proposal to catch up so both issues can be handled together. <br />Councilman Tallon, chairperson of the Finance Committee, reported for Finance Director <br />Copfer: 1) For the year 2005, RITA calculated our cost of collections at 2.41%, which is <br />a decrease from 2004's 2.73%. RITA withholds an estimated 3% retainer from receipts <br />collected each month and calculates the actual cast of collection by participating member <br />once a year. Therefore, the city received $75,315 at the end of June: 70% general fund, <br />15% Permanent Improvement Fund and 15% Solid Waste and Recycling. This goes as a <br />credit to collection expenses. It was not considered in the appropriations as we had <br />received very little the last two years. <br />4 <br />
