Council Minutes of 6/20/2006 <br />made the motion, and the second was by Mr. Miller. Mr. Ryan voted yes on the motion. <br />Roll call continued: Gareau, yes; Tallon, yes. The motion passed unanimously. <br />Resolution No. 2006-133 adopted. <br />Resolution No. 2006-134 was introduced and placed on first reading by Mayor O'Grady. <br />A resolution authorizing the Director of Law to retain outside counsel to assist the City of <br />North Olmsted in matters relating to negotiating a video services (franchise) agreement <br />with AT&T and, in addition, to propose right-of--way regulations related thereto, and <br />declaring an emergency. Councilman Tallon moved for suspension of the rules requiring <br />three readings and formal committee review. The motion was seconded by Councilman <br />Barker. Roll call: Tallon, yes; Barker, yes; Ryan, yes; Gareau, no; Orlowski, yes; Jones, <br />yes; Miller, yes, with reservations. He knows that Walter & Haverfield is a professional <br />organization and expert in this field, but he is sure there is more than one expert in the <br />Cleveland area. If it's an appropriate savings to the city, he would like to see the work <br />spread around a little bit. He thinks sometimes these various agencies, firms, or outside <br />contractors assume they are always going to get the work and kind of plug it in to their <br />costs. Maybe we ought to let them know it's not a guaranteed deal. The motion passed <br />with six yes votes and one no vote. Councilman Ryan asked the Law Director if he felt <br />he needed this passed and through Council as quickly as possible. Law Director Dubelko <br />answered yes. Councilman Tallon moved for adoption, and the motion was seconded by <br />Councilman Ryan. Roll call: Tallon, yes; Ryan, yes; Gareau, no; Barker, yes; Jones, yes; <br />Orlowski, yes; Miller, yes. The motion passed with six yes votes and one no vote. <br />Resolution No. 2006-134 adopted. <br />Ordinance No. 2006-135 was introduced and placed on first reading by Councilman <br />Miller on behalf of himself, Council Member Dailey Jones and Mayor O'Grady. An <br />ordinance creating new Chapter 1142 (Residential Office District) of the North Olmsted <br />Zoning Code in order to establish a new district of permitted uses. Councilman Miller <br />thanked the Law Dept. for their diligence in bringing this forward as it is an issue that <br />needs to be addressed. However, both he and Mrs. Jones feel that this is a work in <br />progress and not necessarily the final product. This legislation will be reviewed by <br />Council along with at least one of the boards and commissions, and it may not be the <br />final product. Law Director Dubelko said he hoped Council will join him in also <br />thanking the Planning Director who helped him with this legislation. Councilman Miller <br />said absolutely and apologized for not mentioning Ms. Wenger, whom he often thanks <br />for her work. <br />Ordinance No. 2006-136 was introduced and placed on first reading by Mayor O'Grady <br />An ordinance to amend Sections 2 and 3 of Ordinance No. 2006-22, as amended, to <br />provide for the issuance and sale of bonds in the maximum aggregate principal amount <br />$2,510,000 for the purpose of refunding at a lower interest cost the city's outstanding <br />Recreational Facilities Bonds, Series 1996A, that were issued as part of a consolidated <br />issue of various purpose improvement bonds, Series 1996, dated as November 15,1996, <br />and are stated to mature on December 1 in 2016 and 2021; and declaring an emergency. <br />Councilman Tallon moved for suspension of the rules requiring three readings and formal <br />committee review.
