Council Minutes of 5/16/2006 <br />Council Member Dailey Jones congratulated the administration in working with ODOT <br />to get the date moved up to fix the sound barrier walls. Some walls are completely <br />missing, or falling into properties-the condition is outrageous. Mayor O'Grady thanked <br />Council Member Dailey Janes for her support on the sound barrier wall issue. Mrs. Jones <br />inquired if Olmsted Township had communicated with the city about a project next to <br />Cinnamon Woods with regard to sewer lines, potential for flooding, and potential for run- <br />off from former farm land. Service Director Limpert commented we have no jurisdiction <br />as far as engineering or being involved in inspections as the project is in Olmsted <br />Township. However, they do fall into the North Olmsted sewer district. When they <br />come forward with a plan, they will be coming to us as far as tap-in fees, etc. The <br />Service Dept. has made phone calls to the Olmsted Township Building Commissioner <br />and to the Cuyahoga County Soil and Water District as far as expressing concerns we had <br />that the property that seems to be being cleared and developed is not properly fenced off. <br />We have been informed there is a certain amount allowed to be done as far as clearing, <br />that those fences are not required. However, we have commitments from both the <br />Township and the Soil and Water District they would send inspectors out to look into it. <br />Law Director Dubelko: 1) Reviewed contracts for Recreation, Springvale, WWTP, <br />Service, and the Mayor's office. <br />2) The department is continuing to work on its organizational structure. Conditional <br />offers have been extended to two law clerks for the summer. He is still gathering <br />resumes for new Assistant Law Director position. Issued RFP's for outside legal <br />services, and the proposals are due back the end of May. <br />3) Attended Board of Control meetings and directors' meetings. <br />4) Civil litigation report: C & C Realty v. Board of Zoning Appeals, previously reported <br />the city had prevailed in the 2506 appeal. Since then, the appellant filed a request for <br />findings of fact, conclusions of law denied by the trial court. An appeal has been taken <br />and is in process of being scheduled for apre-hearing conference in the Court of Appeals. <br />Councilman Miller asked for an update on his legislative request regarding rezoning for <br />the Bradley Road triangle. Law Director Dubelko said he had referred it to the Planning <br />Director for discussion at the Zoning Advisory Committee. Planning Director Wenger <br />came forward and said a new potential district was discussed at the last meeting, and it <br />was the desire of the committee that changes were recommended. The committee would <br />like to have another discussion about those lingering issues before it is presented to <br />Council. Two members of Council are represented on that committee, and the committee <br />is working quickly. Councilman Miller noted that a letter from the Law Director dated <br />April 12 asked that Council address the issue quickly. Anything she can do to expedite it <br />would be appreciated. Councilman Gareau, member of the Zoning Advisory Committee, <br />explained that the f rst meeting actually pre-dated the April 12 letter, and the second <br />meeting was last week. The draft ordinance was prepared by Ms. Wenger and the Law <br />Dept. and circulated among members of committee. Each member provided feedback <br />and had around-table discussion at the last meeting. It is a work in progress. Mayor <br />O'Grady commented the administration had been working on this issue for some time. <br />There are some concerns with the approach that Councilman Miller proposed through his <br />legislative request, and they have another direction.
