Council Minutes of 5/3/2006 <br />2) Councilman Orlowski made a motion to amend Ordinance No. 2006-84 as reported <br />plus with the additional change in the title and any place within the legislation that the <br />position be Youth Services Administrator. The motion was seconded by Councilman <br />Gareau and passed unanimously. <br />3) Councilman Orlowski made a motion to amend Ordinance No. 2005-158 in <br />accordance with the committee's recommendations asreported out. The motion was <br />seconded by Councilman Gareau. Roll call: Orlowski, yes; Gareau, yes; Dailey Jones, <br />yes; Barker, yes; Miller, yes; Ryan, no; Talton, yes. The motion passed with six yes <br />votes and one no vote. <br />4) Continuing with committee agenda items: <br />• Ordinance No. 2006-56 creating a new Section 533.16 of the North Olmsted <br />Codified Ordinances entitled "Registered Offenders -Local Regulations," in <br />order to locally regulate residency and other enumerated activities in North <br />Olmsted of persons who are required to register under any provision contained in <br />Ohio Revised Code Chapter 2950, and declaring an emergency, as amended. <br />There was a discussion on the distance from an elementary or secondary public <br />or private school, library or childcare facility. The committee was comfortable <br />with the 1,000 foot distance from a building, which is the same as the State <br />Revised Code for schools. Libraries and childcare facilities are being added. <br />The Safety Director relayed some concerns of the Mayor regarding this <br />legislation. He is concerned that Council may be over-regulating beyond what <br />the State of Ohio allows or encompasses, specifically schools. His concerns are <br />with the added areas. Mr. Orlowski does not believe any facilities are being <br />added which any parent would not feel comfortable with for the protection of <br />their children, or areas which other communities have included. The registration <br />of certain sex offenders is not being required as this is governed by Ohio Revised <br />Code. The Law Director performed in-depth research and examination of other <br />ordinances, state code and challenges to these types of ordinances and feels <br />comfortable that this is a workable piece of legislation. The committee <br />unanimously recommended approval as amended. Councilman Orlowski made a <br />motion to amend Ordinance No. 2006-56 to change the distance from 2,000 feet <br />to 1,000 feet and in accordance with the committee's other recommendations. <br />The motion was seconded by Councilman Gareau. Roll call: Orlowski, yes; <br />Gareau, yes; Dailey Jones, yes; Talton, yes; Ryan, yes with comment. He <br />believes the distance should stay at 2,000 feet, but wants this legislation to go <br />forward. Roll call continued: Miller, yes; Barker, yes. The motion passed <br />unanimously. <br />5) Next week is National Corrections Officers Week, which is also being observed by the <br />county. <br />Council Member Dailey Jones, chairperson of the Streets & Transportation Committee: <br />1) The committee met on Tuesday, April 26. Present were committee members 3ones, <br />Barker, Ryan; Council Members Orlowski, Gareau; Law Director Dubellco, Service <br />Director Limpert and guests. The committee met regarding Resolution No. 2006-85, a <br />resolution regarding a cooperation agreement for the resurfacing of Lorain Road from <br />11 <br />~~~ <br />
