Council Minutes of 5/3/2006 <br />Brookpark Road to the east corporation line. Mr. Dubelko explained that the Finance <br />Director contacted the Ohio Department of Transportation regarding the wording of the <br />contract, which was different than the wording of the contract with the state when Lorain <br />Road west was resurfaced. That contract stated that the city was responsible for ZO°lo of <br />any cost overages that may occur during the project; this contract states that the city is <br />responsible for 100% of any cost overages that may occur during the resurfacing of <br />Lorain Road east. Mr. Dubelko rE~arted that ODOT will not make any substantive <br />changes to the contract. Mr. Limpert stated that he was being verbally told by ODOT <br />that the responsibility of the city was 204% the whole way through, but did not have that <br />in written format. Mr. Dubelko reasoned. that, even if the city would be stuck on the line <br />for cost overages, ODOT would not change the terms of the contract and Council needs <br />to pass this resolution at the beginning of May in order to qualify for the grant money we <br />are to receive from the state. The committee asked if any documentation could be made <br />available to us from ODOT clarifying this issue, but was told that ODOT said any <br />changes made to the contract would be adeal-breaker. Mr. Dubelko added that the <br />maintenance of the streets in our city is our responsibility. The committee eonfumed that <br />there were cost overages with the Lorain Road west resurfacing. The committee felt that <br />there was no choice but to pass the legislation knowing that the city qualified for the <br />grant and the city does not have the financial resources to complete a project such as this <br />without the state's assistance. The committee agreed to watch this project closely. The <br />committee unanimously reconunended approval of the legislation to Council with <br />passage under suspension of the rule. <br />2) Earlier this week, the Law Director suggested adding additional page to <br />Resolution 2006-85 which he believes Y be helpful to the city in the event that, during <br />or after completion of the project, there are additional costs that the city believes the <br />state, rather than the city, should bear. Council Member Dailey Jones made a motion to <br />amend Resolution No. 2006-$5 by adding the following sentence under the second <br />Whereas clause at the end of the fast paragraph under that clause: "The LPA. agrees to <br />assume and contribute twenty percent (2(?~/0) of the cost and expense of the construction <br />phase of this improvement determined to be eligible for state highway funds." The <br />motion was seconded by Councilman $arker and passed unanimously. <br />Law Director Dubelko asked to make a friendly amendment to the report.. The difference <br />in language wasn't in the legislation relating to the reconstruction of the west end of <br />Lorain Road, but it was in the preliminary legislation far this project. <br />LETTERS AND CQ~NICAT~ONS <br />Finance Director Copfer commented that, before the April 18 Council meeting, she had <br />distributed letters to Council Members which were in support of the Network <br />Administrator. She inadvertently did not specifically request them to be added under <br />Communications in her effort to save time. Therefore, she will place them into the record <br />this evening. (Mrs. Copfer read letters from Fire Chief Thomas Klecan, former Human <br />Resources Director and current Interim Executive Director of the Senior Transportation <br />Connection of Cuyahoga County Dan Copeland, and Recreation Commissioner Ted <br />DiSalvo.
