Council Minutes of 5/3/2006 Brookpark Road to the east corporation line. Mr. Dubelko explained that the Finance Director contacted the Ohio Department of Transportation regarding the wording of the contract, which was different than the wording of the contract with the state when Lorain Road west was resurfaced. That contract stated that the city was responsible for ZO°lo of any cost overages that may occur during the project; this contract states that the city is responsible for 100% of any cost overages that may occur during the resurfacing of Lorain Road east. Mr. Dubelko rE~arted that ODOT will not make any substantive changes to the contract. Mr. Limpert stated that he was being verbally told by ODOT that the responsibility of the city was 204% the whole way through, but did not have that in written format. Mr. Dubelko reasoned. that, even if the city would be stuck on the line for cost overages, ODOT would not change the terms of the contract and Council needs to pass this resolution at the beginning of May in order to qualify for the grant money we are to receive from the state. The committee asked if any documentation could be made available to us from ODOT clarifying this issue, but was told that ODOT said any changes made to the contract would be adeal-breaker. Mr. Dubelko added that the maintenance of the streets in our city is our responsibility. The committee eonfumed that there were cost overages with the Lorain Road west resurfacing. The committee felt that there was no choice but to pass the legislation knowing that the city qualified for the grant and the city does not have the financial resources to complete a project such as this without the state's assistance. The committee agreed to watch this project closely. The committee unanimously reconunended approval of the legislation to Council with passage under suspension of the rule. 2) Earlier this week, the Law Director suggested adding additional page to Resolution 2006-85 which he believes Y be helpful to the city in the event that, during or after completion of the project, there are additional costs that the city believes the state, rather than the city, should bear. Council Member Dailey Jones made a motion to amend Resolution No. 2006-$5 by adding the following sentence under the second Whereas clause at the end of the fast paragraph under that clause: "The LPA. agrees to assume and contribute twenty percent (2(?~/0) of the cost and expense of the construction phase of this improvement determined to be eligible for state highway funds." The motion was seconded by Councilman $arker and passed unanimously. Law Director Dubelko asked to make a friendly amendment to the report.. The difference in language wasn't in the legislation relating to the reconstruction of the west end of Lorain Road, but it was in the preliminary legislation far this project. LETTERS AND CQ~NICAT~ONS Finance Director Copfer commented that, before the April 18 Council meeting, she had distributed letters to Council Members which were in support of the Network Administrator. She inadvertently did not specifically request them to be added under Communications in her effort to save time. Therefore, she will place them into the record this evening.
