Council Minutes of 2/21/2006 <br />Ordinance No. 2005-178 introduced by Mayor O'Grady was given its second reading. An <br />ordinance providing for the submission to the electors of the City of North Olmsted of an <br />amendment to Article VIII, Section 6 of the Charter of the City of North Olmsted to authorize <br />two additional exceptions to local competitive biddings that are permitted by State law, and <br />declaring an emergency. Councilman Gareau moved for suspension of the rule requiring three <br />readings. The motion was seconded by Councilman Barker and passed unanimously. <br />Councilman Gareau moved for adoption. The motion was seconded by Council Member Dailey <br />Jones. Roll call: yes votes: Gareau, Dailey Jones, Barker, Miller, Orlowski, Talton; no vote: <br />Ryan. The motion passed with six yes votes and one no vote. Ordinance No. 2005-178 adopted. <br />Ordinance No. 2005-179 introduced by Mayor O'Grady was given its second reading. An <br />ordinance providing for the submission to the electors of the City of North Olmsted of an <br />amendment to Article II of the Charter of the City of North Olmsted providing that duties and <br />procedural requirements unilaterally imposed by the State upon municipal corporations that <br />purport to limit exercises of local self-government power, shall not be binding upon or applicable <br />to the City of North Olmsted, unless expressly authorized in the city Charter or by city ordinance, <br />and declaring an emergency. Councilman Ryan moved for suspension of the rule requiring three <br />readings. The motion was seconded by Council Member Dailey Jones and passed unanimously. <br />Councilman Ryan moved for adoption. Ordinance No. 2005-179 adopted. <br />Ordinance No. 2005-180 introduced by Mayor O'Grady was given its second reading. An <br />ordinance providing for the submission to the electors of the City of North Olmsted of an <br />amendment to Article VI, Section 4, of the Charter of the City of North Olmsted authorizing the <br />Civil Service Commission, in accordance with Ohio Supreme Court decisions and to the extent <br />permitted by the Charter, to lawfully adopt and enforce local rules and regulations that may be <br />different from the State's Civil Service statutes, and declaring an emergency. Councilman Ryan <br />moved for suspension of the rule requiring three readings. The motion was seconded by Council <br />Member Dailey Jones and passed unanimously. Ordinance No. <br />2005-180 adopted. <br />Ordinance No. 2006-1 introduced by Councilman Gareau on behalf of himself and Councilman <br />Miller was given its second reading. An ordinance providing for the submission to the electors of <br />the City of North Olmsted of an amendment to Article IV, Section 9 of the Charter of the City of <br />North Olmsted to eliminate the requirement that Council vote only by roll call, thereby enabling <br />Council to provide by rule for other authorized methods of voting upon the issues that come <br />before it, and declaring an emergency, as amended. Councilman Gareau moved for suspension of <br />the rule requiring three readings. The motion was seconded by Councilman Ryan and passed <br />unanimously. Dennis Lambert, 25057 Carey Lane, said roll call had been used for decades as is <br />mandated in the Charter. He continues to believe the Council Rules should be codified. He feels <br />this legislation is self-serving and is suspicious of the motives. Councilman Gareau said he felt <br />Mr. Lambert's comments were not warranted. He noted the legislation had been reviewed and <br />approved as amended by the Charter Review Commission. Councilman Ryan noted the IGR <br />Committee had spent a lot of time discussing this legislation and that Council would always vote <br />by roll call as to permanent, important issues. Councilman Orlowski said he had early <br />reservations about the legislation, but he was glad to have the amendment as suggested by the <br />Charter Review Commission. Council Member Dailey Jones noted she had been a previous <br />member of the Charter Review Commission and was a member of the IGR Committee and felt <br />the legislation was appropriate. Councilman Ryan moved for adoption. The motion was <br />seconded by Councilman Gareau and passed unanimously. Ordinance No. 2006-1 adopted. <br />18 <br /> <br />
