Council Minutes of 2/21/2006 <br />Director Wenger for her hard work and a good job with her involvement with this <br />project. The committee unanimously recommended approval of the legislation. <br />• Resolution No. 2006-4, a resolution authorizing the Mayor on behalf of the City of <br />North Olmsted to enter into an agreement with the North Olmsted School District, <br />granting the school district a license to install arxi maintain a removable fence on <br />Diamond Number One Baseball Field at North Olmsted Park, and declaring an <br />emergency. Mr. Hyland, representing the schools, was in attendance. This project is <br />to install a removable fence to have field measurements of 385 feet in deep center field <br />and right and left lines of 315 feet. The cost of the fence will be paid for by the North <br />Olmsted School District and is in the $17,500 range. It will have 48 panels that are 12 <br />feet wide by 6 feet high with the yellow safety cap across the top. There will be 49 <br />sleeves in the grourxl that the fence pasts will fit into. The in-ground sleeves will be <br />capped and covered with sand when the fence is removed. There will also be 40 feet of <br />fence on each sideline which will be permanent. The fence will be installed, maintained <br />and removed by the maintenance department of the schools. It will be up from about <br />the end of March through the end of May. The fence will be stared off site by the <br />school's maintenance department. If the fence is requested to be up longer by the city <br />for other baseball services, that is not a problem. Mr. Hyland said that the schools <br />need a 24-hour notice to take the fence down. Concerns raised by Cour~il included if <br />there were any trees that needed to be removed, would the Cub Scouts still be able to <br />play in the summer, Homecoming aril All Scouts weekend. Also, if the aesthetics of <br />the fence or residents' corr~laints regarding losing the open-space appearance of the <br />park came into question. There was discussion concerning the Cub Scouts who come <br />up to the park twice a week during the spring aril summer to play baseball on or near <br />the area of the proposed fencing. Mr. Ryan and Mr. Miller's concerns were assuaged <br />by Commissioner DiSalvo that, even though there doesn't appear to be an agreement or <br />scheduled time for the Cub Scouts, if the proposed fence was an issue, then the <br />suggestion would be to move the Cub Scouts down to the football field area Mr. Ryan <br />was happy to be able to have an answer for the parents involved with ~ Cub Scouts <br />regarding the playing of baseball at North Olmsted Park. If any trees need to be <br />removed, then the schools have offered to have a 10 to 1 ratio of replacement. Council <br />asked that the replacements be established trees. Council requested of Law Director <br />Dubelko that he aril the administration please keep those concerns in miml when matting <br />up this contract. Council's opinion would be to have ashort-term renewable contract, <br />then along-term contract. The Law Director was in full agreement with Council's <br />questions and comments. The resolution wilt provide that the city aril school district <br />have a license agreement. In Mr. Dubelko's opinion, this is a better way to go than <br />just a handshake between the two entities. Mr. Hylarui's viewpoint was, if the city had <br />any concerns, he would remove the fence. His future plans, if the capital improvement <br />levy passes, is that this fence would be used at a new field in the future. Council was <br />in agreement to let the city and school district negotiate and it is up to them to decide <br />on any restrictions. Mr. Gareau commented that we all know we have a shortage of <br />ball fields for the city oral hopes that this can work out in the long run so the high <br />school team would not have to move somewhere else to have home games. The <br />committee unanimously recommended approval of the legislation by Council under <br />suspension of the rule. <br />Councilman Orlowski, chairperson of the Public Safety, Health & Welfare Committee: 1) The <br />committee met this evening, February 21. In attendance were all Council members,. the Mayor <br />and all directors, Police Chief Ruple and Lt. Gallagher. Approximately two weeks ago, he <br />received Ordinance 2006-48, which is an ordinance creating new Chapter 763 (Public Dance <br />Halls, Teen Dance Clubs) of the North Olmsted Codified Ordinances in order to regulate dance <br />halls and teen dance clubs, and declaring an emergency. He considered fast tracking this <br />ordinance to protect the public welfare, teenagers, neighbors and residents of North Olmsted. <br />Currently, there are several issues which have come to his attention, and he feels it is best to hold <br />9 <br />
