Council Minutes of 2/'1/2006 <br />increase public awareness about these lenders. On Thursday, February 16, 2006, <br />members of the Law Dept. and the boazd will meet with HUD in Cleveland to participate <br />in a training on the software used to input and track any fair housing complaints that may <br />come into our city. <br />AUDIENCE PARTIC~,PATION <br />Ted Bowman, 27170 Butternut Ridge Road, North Olmsted, is very concerned about the <br />loss of NOMBL to RTA. He has done considerable research on the transit tax and made <br />a lengthy presentation. GCRTA did levy a transit tax legitimately pursuant to 5739.023 <br />of the ORC. He noted that section exempts from the tax the sales of watercraft, outboard <br />motors and motor vehicles. Through its Title Bureaus, the Clerk of Courts has been <br />collecting that 1 % transit tax in error far over 30 yeazs. That tax collected erroneously <br />must be refunded with interest, which exceeded 18% in the eazly 80's. Since RTA was <br />the recipient of the illegal proceeds, so should RTA bear the cost of the refund. He would <br />like to see North Olmsted levy their own tax per ORC 4580.401. He believes this will be <br />windfall for North Olmsted. (Mr. Bowman presented his documents to the Clerk, and <br />copies will be distributed to City Council and the administration.) <br />Law Director Dubelko said that he had provided legal advice to Council on options <br />available to the city during the time period from September, 2004 until City Council was <br />compelled to take the decision that it did in March, 2005. Certainly, if City Council has <br />any residual questions that require legal advice, he will be happy to specifically address <br />them with Council regazding any comments that were made by Mr. Bowman. <br />Charles Dial, 27959 Gardenia, expressed his opinions on the time allotment for audience <br />participation and the issues he thinks are important for Council to address. <br />Dennis Lambert, 25057 Carey Lane, discussed a newspaper article regarding the <br />breathalyzer known as the "Intoxicator 5000." In Florida, a judge is advising defense <br />attorneys how to rule on motions as the manufacturer of the equipment refuses to provide <br />the source code information on how it works. He believes this could have application <br />sometime in the future in North Olmsted. Mr. Lambert paid tribute to former Council <br />Member Carolyn Kasler who recently passed on. He noted she served the community <br />extremely well in several capacities. She will be sorely missed. <br />Don Pangrac, 23470 Sharon Drive, expressed his opinions on the time allotment for <br />audience participation. <br />LEGISLATION <br />Resolution No. 2006-2 introduced by Mayor O'Grady was given is second reading. A <br />resolution authorizing the Director of Public Service to advertise for bids for a one year <br />contract (with an additional automatic one yeaz extension) for laboratory analytical <br />services for the Wastewater Treatment Plant, as per specifications on file in his office, <br />'- and authorizing the Mayor, subject to approval by the Boazd of Control, to enter into a <br />10 <br />-p.~ a~.~.-r~~~ <br />
