Council Minutes of 12/18/2407 <br />$22,000. Both individual and net profits ended below, mostly offset by an increase in <br />withholding. <br />2) Thanks to Council for accommodating the amendment to the final appropriations <br />transfer for the year. <br />3) Thank you to Mr. Tallon for his service to our community and particularly as chairman <br />of Finance Committee where she enjoyed working with him and appreciated his <br />leadership and experience. She hopes he has a great retirement, his "honey do list" is <br />long, and his travels are many. <br />4) She wishes everyone a happy holiday. Merry Christmas and Happy New Year with <br />hope that everyone gets to enjoy their families. <br />Councilman Gareau paid tribute to Councilman Miller who was not able to be present <br />this evening. He will be honored for his service at a future meeting. He hopes everyone <br />keeps Mr. Miller and his family in their thoughts. Mr. Miller has served the city well and <br />should be thanked for his years of service as a Councilman. <br />Councilman Gareau, chairperson of the Building, Zoning & Development Committee: 1) <br />The BZD Committee met jointly with the Streets & Transportation Committee on <br />Tuesday, December 11, 2007 from 6:30 to 7 p.m. Present were committee members <br />Gareau, Orlowski, Jones and Barker; Assistant Law Director Bryan O'Malley; counsel <br />Janet Alter; Law Director Jim Dubelko; Douglas Hogan from the Illuminating Company <br />and Mr. Harbarger representing a number of interested utilities. Two items were <br />discussed: <br />• Ordinance 2007-124, an ordinance to adopt new Chapter 902 entitled "Use of <br />Public Right-of--Way by Service Providers and Contractors Performing Work on <br />Service Provider Facilities" and declaring an emergency as amended. This was <br />the second meeting to discuss this particular piece of legislation. The committee <br />took the posture between the first and second meeting that the administration <br />would solicit input and comments from the various interested utilities. A number <br />of comments were incorporated into the copy that was provided to the committee. <br />Some suggested changes were discussed: First, above-ground facilities were <br />def ned and controlled as 902.1 (b) and 902.06 (a) (2). Second, there was a <br />presumed consent provider systems was verified at 902.02 (a). The third one <br />could be summarized as an amendment was a provision and designation of maps <br />exemption from public records for propriety for security information as 902.02 (e) <br />(f) and 902.03 (d). This is a very comprehensive piece of legislation. Fourth was <br />the insurance and bond requirements adjusted from $5 million to $3 million at <br />902.04 (a) (1). Notice of work when required was amended at 902.07. <br />Construction permits, when required, were amended at 902.08. Hearing <br />procedure was revised to delete hearing by the Service Director at 902.10. <br />Miscellaneous provisions were located at 902.11. Those items are the significant <br />amendments that were discussed that evening, but it is not an exhaustive list. The <br />committee was provided with a redline copy to show the changes. Those changes <br />have been brought forward in the copy before Council this evening. Also, there <br />were at least two other changes that were brought forward by the administration <br />4 <br />
