Council Minutes of 12/18/2007 <br /> <br />subsequent to that meeting. In 902.04 (c) (1), Mr. Jim Burns had made <br />commentary concerning the Director of Finance in that section and the role she <br />would play. The Director of Law has been substituted to serve in that capacity. <br />Also, a fund was created for fees to segregate them. That change is also included. <br />The committee, after receiving good input from Mr. Hogan and Mr. Harbarger, <br />did recommend approval by a vote of 4-0. (Two members from each committee) <br />• Ordinance 2007-133, an ordinance amending Sections 901.04 and 901.05 of <br />Chapter 901, (Excavations) of the Streets, Utilities, and Public Services Code, <br />respectively entitled "Contractor To Make Street Repairs; Failure to Comply" and <br />"Deduction and Refund" in order to regulate right-of--way excavation deposits and <br />restoration by private contractors not affiliated with public utilities of <br />communication companies and declaring an emergency as amended. This is a <br />companion piece of legislation. Sometimes service work has been done in the <br />right-of--way by people other than utilities, and then we find that the road is just <br />left in a condition that is no where near what is was before they cracked the street <br />open. This legislation will provide for standards and the posting of bonds for <br />private contractors hired by land owners to make sure that the work remains in the <br />same quality that it was and it doesn't sink or deteriorate over the course of time. <br />He and Councilwoman Jones sponsored this legislation. The committee <br />recommended approval unanimously. As an emergency clause needed to be <br />added to the legislation, Councilman Gazeau made a motion to amend Ordinance <br />2007-133 to include an emergency clause. The motion was seconded by <br />Councilwoman Jones and passed unanimously. Ordinance No. 200?-133 <br />amended. <br />2) Councilman Gareau made a motion to amend Ordinance 2007-124 consistent with <br />those amendments that were discussed in committee and as set forth in the current <br />version of Ordinance 2007-124 as amended. The motion was seconded by <br />Councilwoman Jones. The motion passed unanimously. Ordinance No. 2007-124 <br />amended. <br />Councilman Tallon, chairperson of the Finance Committee: 1) The Finance Committee <br />met on Tuesday, December 11 at 7:50 p.m. In attendance were committee members <br />Tallon and Ryan; Council Members Barker, Orlowski, Jones and Gareau; Council <br />President Kennedy and Council Member-elect Kearney; directors Copfer, Dubelko, <br />Limpert, and Farver; Mayor; guests. Agenda items: <br />• Resolution 2007-146, a resolution authorizing the Director of Human Resources <br />on behalf of the City of North Olmsted to apply to the Bureau of Workers <br />Compensation for allowance to begin aself-insured workers compensation <br />program for North Olmsted employees; further authorizing the Mayor to execute <br />any contracts or related papers required to effectuate such aself-insured program <br />and declaring an emergency. Director Farver gave a brief overview and <br />introduced Mr. John Motil from our TPA who gave an in-depth overview of what <br />the resolution will do. Basically, the city will become self-insured in the matters <br />of workers compensation. The city assumes a greater amount of risk for which <br />5 <br />
