Councilman Tallon made a motion to amend <br />Ordinance 2007-128 as read. The Law Director suggested Mr. Tallon add "in <br />accordance with the amended version before Council tonight" to his motion. Mr. <br />Tallon agreed to include the Law Director's suggestion in his motion of adoption. <br />The motion was seconded by Councilman Miller and passed unanimously. <br />Ordinance 2007-128 amended. Mr. Tallon noted that the committee had <br />unanimously recommended approval by Council. <br />• Ordinance 2007-134, an ordinance creating new Section 131.02 of the <br />Administrative Code entitled "Authority to Accept Donations" in order to <br />authorize the Mayor to accept certain donations on behalf of the city. After an <br />overview by the Law Director and Finance Director, a discussion was held and <br />some recommendations were made to change this ordinance. The changes are as <br />follows: Section 1, (B), the first sentence will now read, "Prior to accepting any <br />such donation of money or personal property that has a value of at least Two <br />Hundred Fifty Dollars ($250.00)"; strike "All such donations accepted by"; "the <br />Mayor" is left in; "on behalf of the City" is stricken; "be evidenced by" is <br />stricken; added is "submit a report to the Clerk of Council"; stricken will be "a <br />writing signed by the Mayor,"; after the words Director of Law, "and" is stricken <br />and "which" is added; after the words shall state, "that" is stricken. In 131.02, <br />Authority to Accept Donations, (3), the amount will be changed from $5,000 to <br />$1,000. In Section 1, (C), a new Section 3 is added: "For purposes of this <br />section, an `unconditional' gift is one in which there is no obligation imposed by <br />the donor upon the City as a condition of acceptance. A gift shall not be <br />considered `conditional' if the donor simply restricts the use of the gift to a <br />particular department or division of the City or, if the gift is money, the fund into <br />which the money shall be deposited." Councilman Tallon made a motion to <br />amend Ordinance 2007-134 as submitted in writing. Councilman Miller, noted <br />for clarification, there was an extra "be" after the word "shall" under (C). Law <br />Director answered it was a typo. The motion was seconded by Councilman Miller <br />and passed unanimously. Ordinance 2007-134 amended. Councilman Tallon <br />noted the committee had unanimously recommended approval of the legislation to <br />Council. <br />Councilman Orlowski, member of the Intra-Governmental Relations Committee, reported <br />for Councilman Ryan: 1) The Intra-Governmental Relations Committee meeting of <br />Tuesday, November 13, 2007, was called to order at 8:08 p.m. The chairman was unable <br />to attend due to an illness. Larry Orlowski chaired the committee meeting. In attendance <br />were committee members Jones and Orlowski; Council Members Barker, Gareau, Miller, <br />Tallon and Kennedy; the Safety Director, Law Director, Finance Director; guests. <br />Resolution 2007-132 was reviewed, a resolution supporting the preservation of customer <br />choice through Ohio electric governmental aggregation. Ohio electric governmental <br />aggregation is the best choice, considering the current legislature in Columbus, In reality, <br />the best choice for the residents of Ohio is an end to de-regulation and returning to the <br />regulation of utilities. The committee voted unanimously to recommend adoption by all <br />of Council. <br />5 <br />
