The committee unanimously <br />recommended adoption by Council. <br />2) Councilman Orlowski made a motion to return Ordinance 2006-128, as discussed in <br />committee and as presented in written form to Council, back to committee for further <br />review as per reasons cited by the Law Director in his e-mail of October 29, 2007. The <br />motion was seconded by Councilman Ryan. Councilman Gareau noted that this is the <br />legislation concerning the requirement that doors be closed on the facilities that operate <br />spray painting. Roll call: Orlowski, yes; Ryan, yes; Tallon, yes; Jones, no; Barker, no; <br />Gareau, no; Miller, yes. The motion passed with four yes votes and three no votes. <br />Council Member Dailey Jones, chairperson of the Streets & Transportation Committee: <br />1) The committee met on October 23, 2007. Present were committee members Barker <br />and Jones; Council Members Gareau, Miller and Orlowski; Service Director 1_,i~mpert, <br />Asst. I.,aw Director O'Malley, the City Engineer. The committee met regarding <br />Ordinance 2007-119, at7 ordinance locally designating and naming the entire section of~ <br />County Road .Nos. 76 and 11.8 as located within the City of North Olmsted, from the <br />City's southern corporation line to its northern corporation line, Stearns Road. This puce <br />of legislation. was brought to Council shortly after having received Resolution 2007-1 13, <br />rt resolution urging the Cuyahoga County Engineer to name the new section of County <br />Road 76 from Lorain Road north Co the North Olmsted corporate line Stearns Road. The <br />Law Director had counseled that Resolution 2007-11.3 should be held because the <br />administration was working with the Cuyahoga County Engineer's office on this <br />particular issue and the language that was needed had to be precise and speak to the point <br />which the County ingincer's Office had in place. A concern was raised as to the second <br />~~'hereas clause asking if the word "extension" should. be deleted from the clause. "Phis <br />clause reads, "Whereas, the. North Olmsted Lat7dmarks Commission has recommended to <br />the administration and the City Council that the currently Linder consttti~ction extension of <br />County Road 76, known as County Road 118, which in North Olmsted will be located <br />hetwcen Lorain Road and the north corporate line of North Olmsted, should continue tip <br />bear the Warne of this honored founding family of North Olmsted." The Service Director <br />stated that, in his conversations with the County Engineer's office, the language in <br />Ordinanec 2007-1 19 was sufficient to name the new section of road being constructed as <br />`~tearns load. Because there was still some question as to whether or not the language ol~ <br />the second whereas clause should he changed to state that the entire leny~th of the ne~v <br />road, both in North Ulrrlsted anal 1~'estlake, is an extension of C'FZ 1 18 (C:'rocl<er Road) <br />rather than o1~C'R 76 (Stearns Road.), the committee requested that the Law Director give <br />leis opinion on the subject. The committee Lunanimously recommended approval ol~~ the <br />legislation by Council. On October 26, 2007, the Law Director responded to the inquiry <br />with an e-mail to Council explaining that he reviewed the origin of the language in <br />Ordinance No. 2007-1.1.9 that was questioned and found that it comes from the second <br />Whereas clause of pendi~t~g Resolution No. 2007--113. So, assuming that the language i^ <br />the original legislative request for Resolution No. 2007-113, which stated that the <br />L.a~ldmarks Commission had requested that CR 76 from the Olmsted 'Township line to the <br />\V~stlakc line be named "Stearns Road" is true, then there is nothing incorrect in the <br />second Whereas clause of Ordinance ?007 -1 l9, which would then simply ret~ect what <br />7 <br />
