Council Minutes of 10/16/2007 <br /> <br />7) The annual leaf pick up will begin next Monday in Ward 3. <br />8) Concrete will be poured next Monday, weather permitting, for the permanent street on the east <br />side of Stearns Road between I-480 and Lorain. The street will be closed to through traffic on <br />that day. Once that concrete cures, we will transition over and motorists will be using that <br />finished roadway to transit Stearns Road as work on the west side of the street is completed. <br />9) With regard to legislation, he asks those committees that are holding legislation in committee <br />to more it forward. <br />Finance Director Copfer read Law Director Dubelko's report: 1) On October 3, he attended the <br />court-ordered mediation in the Nancy Kovacic litigation. The plaintiffs' case against the city was <br />settled in accordance with the settlement authority memorandum he previously provided to <br />Council. The settlement encompasses all of the claims of the plaintiff mother as well as those of <br />,b both of her minor children, and comprehensively includes the city and all of its officials and <br />employees who were involved in this matter. Probate Court will approve the settlement with <br />respect to the minor children. <br />2) On October 4, the city received notice that HUD had completed its annual review of the city's <br />fair housing program and had approved the city's program as "substantially equivalent." <br />Congratulations to Asst. Law Director Carole Heyward for her good work in administering the <br />city's program during the past year, and to the city's Fair Housing Review Board, especially its <br />chair, Councilwoman Nicole Dailey Jones, for her enthusiastic support of fair housing in the city. <br />3) On October 8, he received the final draft of Asst. Law Director Heyward's proposed real ~ " <br />property maintenance initiative for the city. The report will be timely provided to the Mayor, <br />Finance Director and other administration officials for inclusion and consideration in the budget <br />discussions for 2008. <br />4) On October 10, following the prior evening's BZD committee meeting regarding the half-way <br />house legislation and in response to comments made by residents at that meeting, he conducted <br />further review and research regarding the use of the property at 6044 Gareau Drive. Also he <br />provided assistance to the Building Dept., which led to the Building Dept. sending a violation <br />notice to the property owner on October 12. Building inspectors will visit the property on <br />October 19 to determine whether the violation has been abated. If not, the matter will be turned <br />over to the Law Dept. for enforcement action. <br />5) On October 11, he attended a lengthy, but very productive meeting of the Records <br />Commission. Commission members Finance Director Copfer and Human Resources Director <br />Farver were in attendance. The commission, with the assistance of the Mayor's Administrative <br />Assistant Annie Kilbane, Finance Department secretary Donna Murphy, and. law clerk Erika <br />Schindler made substantial progress in its review of the proposed retention schedules for City - <br />Council and the Building Department. It is anticipated that the schedules for Council and <br />Building when further revised and improved will be able to serve as models to be used by the <br />other departments and divisions of the city. <br />6) On October 15, he attended the HB9 mandated public records training at a seminar put on by <br />the Ohio Attorney General's office at Lorain Community College. Also in attendance were the <br />Mayor, the Finance Director and the Human Resources Director. He previously corresponded <br />'~ with City Council regarding the changes in public records law effected by HB9 and will continue <br />$, to make the Law Department's resources available to City Council with respect to any public <br />records law questions. <br />7) Litigation report from Asst. Law Director O'Malley: In the case of City of North Olmsted v. <br />Scott Koberna, in Rocky River Municipal Court, the city's complaint was dismissed with costs <br />split equally and with the defendant's stipulation that the rocks are not on defendant's property <br />2 <br />
