Council Minutes of 10/16/2007 <br />and therefore defendant has no objection to their removal if deemed necessary by the city or <br />neighboring property owner. <br />8) On October 11, Asst. Law Director O'Malley made a presentation to the Cuyahoga County <br />Law Directors Association on the ongoing Tic-Tac-Fruit controversy in Ohio. The meeting was <br />well attended by Law Directors throughout Cuyahoga County. <br />Finance Director Copfer: I) The estate tax collections for the second half of 2007, which closed <br />the end of August, totaled $340,342 and is not included in the estimated resources of the General <br />Fund. This amount is very similar to the 2006 b collections. We usually receive it in October or <br />November. <br />2) Our IT Consultant and Munis OSDBA support copied our database to a new database to <br />operate in the newest version of Munis for testing purposes. Once we test transactions and are <br />satisfied, we will go live on this version. <br />3) The tax rate resolution is before Council this evening. The county felt the city maybe short in <br />the GO Bond Retirement Fund and recommended moving .l mills from the General Fund to it. <br />This equates to about a $90,000 decrease in the General Fund. Additionally, based on their early <br />estimates of property values, they reduced our assessed valuation by nearly 3%. This comes <br />primarily from the decline in the taxable personal property that is being phased out. <br />Theoretically, we are going to be made whole by the increase in the CAT tax receipts for that <br />portion. As was discussed in caucus, this needs to be to the county by November 1, so it should <br />be passed on suspension. <br />Council President Kennedy: 1) The Committee-of--the-Whole met on Tuesday, October 9, to <br />discuss a water feasibility study. Present were Council Members Gareau, Jones, Barker, Tallon, <br />Miller and Orlowski; Mayor O'Grady, Finance Director Copfer and Service Director Limpert; <br />Bob Kelly, the Director of Engineering for the City of Westlake. Discussed was Phase I of the <br />water systems study to be done by HNTB Corp. at a cost to North Olmsted of $24,900. The first <br />phase will include the development and evaluation of the preliminary alternatives for water <br />distribution system upgrades in the cities of Westlake, Bay Village and North Olmsted required <br />by the changing of water supply from Cleveland to the City of Avon Lake. The goal for Phase I <br />is to provide feedback on the feasibility of changing our water supplier. After Phase I of the <br />study, it should be clear whether the City of North Olmsted should move forward or not. The <br />study will be started soon in the City of Westlake. At this time, the City of Bay Village is not <br />going to participate. Mayor O'Grady made a friendly amendment to the report by saying in no <br />way does this signal any effort on the part of the City of North Olmsted to make any moves <br />towards going away from Cleveland Water. This is just our interest in participating in a water <br />feasibility study. President Kennedy agreed. <br />Councilman Gareau, chairperson of the Building, Zoning & Development Committee: 1) The <br />BZD Committee met on Tuesday, October 9, 2007. Present were committee members Gareau, <br />Miller and Orlowski; Council Members Dailey Jones, Barker, and Tallon; Mayor O'Grady, Law <br />Director Dubelko, Finance Director Copfer, Community Life Services Director Dailey, and <br />Planning Director Wenger. Agenda items included: <br />• Ordinance 2007-103, an ordinance sponsored by Council Members Gareau, Jones and <br />Barker, amending Sections 1115.06 and 1139.01 of the North Olmsted Zoning Code in <br />order to limit the location of correctional facilities to the city's General Retail Business <br />District as originally written.
