Council Minutes of 10/16/2007 <br />~. <br />and their concerns centered primarily upon the ongoing activities of a certain residence <br />on Gareau Drive and the belief that the individual therein was operating what could be <br />construed as a half-way house, or at least a release home for persons who would be <br />reallocated back into society from some prior term in a correctional facility. Legislation <br />was brought about to address this type of situation because our Zoning Code did not <br />provide any particular location for such facilities to locate within the city, supposedly <br />then opening up a discussion about potential future ramifications of not providing for it. <br />If it is not provided for, it is not permitted. The law requires there be a location for this <br />use. The main discussion was on that particular location. Additionally, the question <br />arose as to whether or not the General Retail Business District was the appropriate place <br />~ to locate this use. The committee unanimously recommended that the ordinance be <br />approved with the amendment that the Limited Industry-Industrial Park District be the <br />appropriate and suitable location for correctional facilities as defined in the code. <br />Councilman Gareau made a motion to amend Ordinance 2007-103 as written and <br />presented this evening, which is to change it from the General Retail Business District to <br />the Limited Industry-Industrial Park District. The motion was seconded by Councilman <br />Miller and passed unanimously. Ordinance 2007-103 amended. <br />• Mercedes/Porsche dealership, 28450 Lorain Road, proposal consisting of building <br />additions and site improvements to both the Mercedes and Porsche dealerships. The <br />Mercedes building improvements include showroom extension of the glass curtain wall <br />and structural steel columns and a smaller rear addition. The Porsche building will have a <br />new Alucobond-type wall with a glass base and service drive canopy along the west side <br />of the building. Site improvements for the proposal include additional customer parking <br />in front of both dealerships, additional vehicle storage to the rear of the dealerships, <br />altering the vehicle display areas in the front setback area, modifying the driveways to <br />better accommodate deliveries, a new decorative pavement design at the main entryway <br />between the dealerships, stamped concrete in the tree lawn, new landscaping along the <br />front of the property and in the rear to buffer the expanding inventory area from adjacent <br />residential property. The applicant indicated the lights that would be installed would be a <br />full cut-off light to shield the additional properties to the north from any light spillover. <br />Also discussed was the possibility of any easements existing between the property to the <br />west, the Nissan dealership, and the Mercedes/Porsche dealership. There is no existing <br />easement in place, and it was made clear that there would not be any restriction of that <br />access between the sites without having to come back to the city and seek permission. <br />Additional signage would be added to the site with a wall sign for Mercedes and a <br />Mercedes emblem on a blue pylon attached to the building. Porsche proposed a new <br />ground sign. An issue he wished to bring to the attention of the Council is the day after <br />the BZD meeting, it came to his attention that they indicated engineering requirements <br />for water quality swales conflicted with the landscaping as was presented at the <br />committee meeting. It was indicated there could be trees removed. He asked what kind <br />and how many, and the answer was 36. At that point, the applicant graciously went back <br />and reviewed their plans and was able to accommodate the landscaping plan as presented <br />and approved. They are going to be using permeable pavement as necessary to try to <br />preserve the vegetation and landscaping. Councilman Gareau made a motion to approve <br />the Mercedes/Porsche dealerships, 28450 Lorain Road, site plan improvements subject to <br />the recommendations of the Planning & Design Commission with the exception of the <br />recommendation to save the 36 inch cherry tree because it was not feasible. The motion <br />was seconded by Councilman Orlowski and passed unanimously. <br />4 <br />
