Council Minutes of 9!18/2007 <br />MISCELLANEOUS BUSINESS <br />Councilman Tallon scheduled a Finance Committee meeting for Tuesday, September 25, <br />at 7 p.m. for Ordinances 2007-106 and 2007-99. The Finance Director, Mayor and <br />Directors affected by the transfers are asked to attend. <br />Finance Director Copfer asked Mr. Tallon if the RFP ordinance for professional services <br />was going to be considered. Councilman Tallon said he hadn't planned on discussing it <br />at this committee meeting but would look into it. <br />Councilman Ryan scheduled an Intra-Governmental Relations Committee meeting for <br />7:30 p.m. on Tuesday, September 25, to discuss Resolution 2007-108. The Law Director, <br />Mayor, and Service Director are asked to attend. <br />Councilman Miller scheduled an Environmental Control Committee meeting for 8 p.m., <br />or immediately following the Intra-Governmental Relations Committee, to discuss the <br />nuisance control ordinance. (Councilman Orlowski later noted the correct number of the <br />legislation was Ordinance 2006-179.) The Law Director is asked to attend. <br />Councilman Gareau scheduled a Building, Zoning & Development Committee meeting <br />for 7 p.m. on Tuesday, October 9, to discuss a plan review for Mercedes/Porsche. The <br />Planning Director is asked to attend. <br />Councilman Gareau requested discussion on whether Mr. Ryan's unread comments <br />would be made a part of the record, or whether it would be more appropriate to read them <br />and make them part of the record. Councilman Ryan said his request was it be attached <br />to the minutes as a communication. Law Director Dubelko said Council can do that. It's <br />Council's wishes. A lengthy discussion ensued with Councilman Gareau expressing his <br />feelings that the comments should be read to be made part of the minutes, and <br />Councilman Ryan commenting, as a citizen of the community, he has submitted the <br />comments to be attached to the minutes. Councilman Gareau objected to that and made a <br />motion Council not include a piece of written correspondence in the record that has not <br />been read into the record. The motion was seconded by Council Member Dailey Jones. <br />Councilman Miller asked for a point of order, but President Kennedy ruled there was a <br />motion and second on the floor to include a written piece of information that has not been <br />read into the public minutes. Councilman Ryan asked for a point of order as that was a <br />misstatement of the motion. The motion was to exclude his written communication. <br />President Kennedy corrected his statement and said the motion was to exclude a written <br />piece of information from Mr. Ryan. Councilman Miller called for a point of order and <br />asked for advice from Law Director Dubelko. Law Director Dubelko reviewed the Rules <br />of Council and said the only reference to written communications is in Rule 12 which <br />indicates the Clerk of Council shall accept all correspondence including communications. <br />It doesn't make reference as to whether or not those should become part of the minutes. <br />He thinks it's Council's choice as to whether or not it wishes to make communications <br />received by the Clerk of Council as part of the minutes. President Kennedy asked if there <br />was a motion. Hearing none, he asked for further Miscellaneous Business.
