Council Minutes of 9/4/2007 <br /> <br />committee as he had some difficulty with it, but Mrs. Jones felt very strongly that <br />she would like to move this forward. Subsequent to the committee meeting, Mr. <br />Ryan had the opportunity to discuss this matter with Mr. Gareau who also felt <br />very strongly about it and provided excellent input. They agreed the committee <br />should move forward on the legislation. A second committee meeting was <br />scheduled for 7 p.m. on September 7. The committee meeting was held this <br />evening at which time the Planning Director provided the committee with an <br />amended ordinance. The committee recommended that the amendments as <br />presented be made and that the legislation be passed under suspension of the rule. <br />Councilman Ryan made a motion to amend Ordinance No. 2007-102 as presented <br />during this evening's committee meeting. The amendments include in Section <br />174.03 removing the phrase at (a): "An commercial or industrial." In Section <br />174.03 (b) remove, "commercial or industrial" which appears in the first <br />paragraph; remove the entire second paragraph. The motion was seconded by <br />Council Member Jones and passed unanimously. <br />Councilman Orlowski, chairperson of the Public Safety, Health & Welfare Committee: <br />1) The committee met on Monday, August 27, 2007. In attendance were committee <br />members Orlowski and Barker; President of Council Kennedy; Law Director Dubelko, <br />Safety Director Terbrack; guest Jim Burns. Agenda items: <br />• Ordinance 207-82, an ordinance amending Section 755.11 of Chapter 755 <br />(Secondhand Dealers) of the Business Regulation Code, entitled "Hours and <br />Circumstances of Sales," in order to regulate outdoor collection receptacles on <br />commercial property, and declaring an emergency. On August 31, Mr. Orlowski <br />received a memo from the Safety Director in which he provided some additional <br />information regarding the rationale for the proposed changes to the ordinance. <br />• Ordinance 2007-94, an ordinance removing Section 721.02 entitled "Sales on <br />Public Property Prohibited," from the Business Regulation Code, placing it in the <br />General Offenses Code as new Section 521.16, and providing for the offense to be <br />classified as a minor misdemeanor. <br />~ Ordinance 2007-95, an ordinance amending Section 525.16 of the General <br />Offenses Code so as to provide criminal penalties for stores that allow shopping <br />carts to be removed from their facility or property. <br />A brief discussion ensured on each of the three ordinances. The committee voted <br />unanimously to hold all three ordinances in committee pending additional information. <br />LETTERS COMMUNICATIONS <br />"Dear Council Members: The purpose of this letter is to express concern regarding the <br />children's area of the new library. After speaking with many of our preschool PTA <br />members and other parents of small children, it has come to my attention that many <br />parents feel as though the children's section of the new library is lacking organization and <br />privacy. Many have even stated that we should use Westlake Public Library as a model. <br />Let me start off by saying that the family restrooms in the play area are much <br />appreciated. Concerns are surrounding the lack of privacy (and safety) for the children, <br />6 <br />
