Council Minutes of 9/4/2007 <br />those lights that no longer exist. He feels the sewer rate increase should be explained to <br />the residents as a tax because the city owns the utility. <br />Councilman Ryan said he has no problem with people addressing Council, but took <br />exception to speakers who tell Council they are discourteous or should be ashamed of <br />themselves. He is here because he is concerned about his ward and the people he <br />represents. City Council is here to do city business and very carefully consider what is <br />right and what is wrong for the city. He invited residents to call him personally if they <br />have an issue they would like to discuss. <br />Law Director Dubelko commented that legally the sewer rate increase is not a tax. It is <br />important, when City Council passes a sewer rate increase, that they do it under certain <br />utility rules that are different than the rules for taxes. <br />Jerome Barrett, 24125 LeBern Drive, North Olmsted, addressed Councilman Ryan and <br />said he took offense at the "dressing down" and said he felt everybody is entitled to their <br />opinion. That's what democracy is. Debate is very healthy. He has no problem with <br />debate as long as facts are presented to back up assertions. <br />LEGISLATION <br />Ordinance No. 2007-84 introduced by Mayor O'Grady was given its third reading. An <br />ordinance amending Sections 1, 2 and 3 of Ordinance 2003-22, as amended by Ordinance <br />2004-175, in order to authorize the Springvale Facility Manager to charge costs only for <br />city-sponsored events held at the Springvale Golf Course and/or Ballroom facility. <br />Councilman Barker moved for adoption, and the motion was seconded by Council <br />Member Dailey Jones. The motion failed unanimously. Ordinance No. 2007-84 is not <br />adopted. <br />Ordinance No. 2007-86 introduced by Mayor O'Grady on behalf of himself and Council <br />member Dailey Jones was given its third reading. An ordinance amending Section <br />109.02 of the Administrative Code, entitled "Public Meetings," in order to provide for the <br />Law Department legal secretary to provide clerical support to the Fair Housing Review <br />Board. Council Member Dailey Jones moved for adoption. The motion was seconded by <br />Councilman Barker and passed unanimously. Ordinance No. 2007-86 adopted. <br />Ordinance No. 2007-93 introduced by Mayor O'Grady was given its third reading. An <br />ordinance re-authorizing the Director of Public Safety to appoint a temporary, part-time <br />Fire Administrator to assist the new Assistant Fire Chief; re-establishing the pay range <br />for said temporary position; and declaring an emergency. Councilman Gareau moved for <br />adoption, and the motion was seconded by Councilman Barker. Roll call: Gareau, yes; <br />Barker, yes; Miller, no; Orlowski, no; Jones, yes; Ryan, no; Tallon, no. The motion <br />failed with four no votes and three yes votes. Ordinance No. 2007-93 is not adopted. <br />Mayor O'Grady wanted to speak about the legislation, but Council President Kennedy <br />ruled that the vote had taken place and the meeting would move along as there was ne <br />debate occurring. <br />8 <br />
