Council Minutes of 6!19/2007 <br />Resolution No. 2007-67 introduced by Mayor O'Grady was given its second reading. A <br />resolution urging the State to place a moratorium on oil and gas well drilling in heavily <br />populated residential areas and declaring an emergency. Councilman Tallon moved for <br />suspension of the rule requiring three readings noting the legislation had been heard in <br />committee, and the motion was seconded by Councilman Barker. Roll call: Tallon, yes; <br />Barker, yes; Jones, yes; Ryan, no; Orlowski, yes; Gareau, yes. The motion passed with <br />five yes votes and one no vote. Councilman Tallon moved for adoption. The motion was <br />seconded by Councilman Barker and passed unanimously. Resolution No. 2007-67 <br />adopted. <br />Ordinance No. 2007-71 introduced by Mayor O'Grady on behalf of himself and Council <br />Members Ryan and Barker was given its second reading. An ordinance creating new <br />Section 525.21 of the General Offenses Code entitled "False Information," in order to <br />prohibit providing false information to public officers or employees for the purpose of <br />obtaining tuition free assistance at public schools or other public benefits. Councilman <br />Ryan moved for suspension of the rule requiring three readings. The motion was <br />seconded by Councilman Barker and passed unanimously. Dennis Lambert, 25057 Carey <br />Lane, asked what about providing false information for application for recreational issues <br />and other things? Do we have legislation in place protecting us from that as well, and <br />could it be incorporated into this legislation if not? Law Director Dubelko said we have a <br />general falsification ordinance which may have application. Our Prosecutor thought it <br />was too general to serve well and to prosecute this type of conduct. However, this new <br />ordinance not only relates to falsely obtaining education benefits, but it's any public <br />benefit. He believes recreation services could technically be considered a public benefit <br />either under the general falsification ordinance that we-already have or possibly under <br />this. If not, then maybe it's something to look at in the future if it becomes a problem. <br />Councilman Ryan moved for adoption. The motion was seconded by Councilman Barker <br />and passed unanimously. Ordinance No. 2007-71 adopted. <br />Ordinance No. 2007-73 introduced by Mayor O'Grady was given its second reading. An <br />ordinance authorizing the Mayor to enter into an agreement with the Greater Cleveland <br />Regional Transit Authority ("GCRTA"), providing for the maintenance and repair costs <br />for Kennedy Ridge Road, including the terminus thereof, and declaring an emergency. <br />Councilman Gareau moved for suspension of the rule requiring three readings noting the <br />legislation had been reviewed in committee. The motion was seconded by Councilman <br />Orlowski and passed unanimously. Councilman Gareau moved for adoption. The <br />motion was seconded by Councilman Orlowski and passed unanimously. Ordinance <br />No. 2007-73 adopted. <br />Ordinance No. 2007-74 introduced by Mayor O'Grady was given its second reading. An <br />ordinance consenting to and vacating a portion of Kennedy Ridge Road and approving <br />the vacation plat presented by the Greater Cleveland Regional Transit Authority <br />("GCRTA"), and declaring an emergency. Councilman Gareau moved for suspension of <br />the rule requiring three readings noting the legislation had been reviewed in committee. <br />The motion was seconded by Council Member Jones and passed unanimously. <br />16 <br />
