Council Minutes of 6/5/2007 <br /> <br />1. Decibel reading for sound emitting from within the PetSmart building on <br />the front (North side) to be no higher than 65 dBA. <br />2. Decibel reading for sound emitting from within the PetSmart building on the <br />back (South side) to be no higher than 52 dBA. <br />3. Decibel reading for sound emitting from within the PetSmart building on the <br />roof of the building to be no higher than 65 dBA. <br />4. The decibel readings for sound emitting from within the PetSmart building for <br />any tenants adjacent to the PetSmart Store (including the tenant along the East <br />side of the alley way) to be no higher than 20 dBA, as measured from the tenant's <br />side of the adjacent wall. <br />5. Existing East exterior doors are to be used for emergency egress only and shall <br />be equipped with emergency exit alarms. <br />6. The PetSmart Store shall emit no nuisance odors or noise as defined by Section <br />1139.01(d)(2) of the Codified Ordinances. <br />7. The PetSmart Store shall conduct no outdoor animal activities. <br />8. The doors located behind the South side of the building shall not be used for <br />animal ingress or egress. <br />9. PetSmart, at its expense, shall hire independent testers to verify that the facility <br />meets or exceeds the odor and noise level standards specified herein (1) upon <br />completion and utilization of the PetsHotel facility and (2) whenever the Building <br />Commissioner, in his discretion, requests such test(s). <br />10. Testing for noise shall be done at distances of one foot and fifty feet. <br />Councilman Gareau moved to approve the conditional use permit for PetSmart <br />subject to the conditions identified above. The motion was seconded by <br />Councilman Orlowski. Roll call: Gareau, yes; Orlowski, no, with comment. <br />"Even though great strides have been made on protecting the residents under a <br />conditional use permit, I still believe an animal boarding facility belongs in the <br />Industrial Parkway." Roll call continued: Barker, yes; Jones, yes; Miller, no; <br />Ryan, no; Tallon, yes. The motion passed with four yes votes and three no votes. <br />• Ordinance 2007-30, an ordinance amending Section 1135.02 of Chapter 1135 <br />(One and Two Family Residence Districts) of the Zoning Code in order to <br />regulate the placement of portable storage containers in One and Two Family <br />Residence Districts of the City of North Olmsted. The committee discussed the <br />legislation and the amendments which were recommended by the Planning & <br />Design Commission but did not make a recommendation. <br />5 <br />
