Council Minutes of 5/15/2007 <br />represents bad government, and he asks that the experts who work with these issues <br />everyday be allowed to decide when and how to mark city vehicles. <br />Law Director Dubelko: 1) Litigation: <br />• We have received notice of appeal to Common Pleas Court by a property owner <br />located near Christman and Lorain. This is an administrative appeal from a <br />decision of the Boazd of Zoning Appeals and Planning & Design Commission <br />denying an application for a minor subdivision. <br />• Received notice from the 8`h District Court of Appeals that the city prevailed in its <br />defense of an appeal by C & C Realty from a denial of a use variance that was <br />appealed to Common Pleas Court. Common Pleas Court affirmed it, and now the <br />8`h District Court of Appeals has agreed. This involved Halleen Kia. It probably <br />is the end of the litigation. Halleen could seek a further review by the Ohio <br />Supreme Court, but that would be a discretionary appeal and unlikely to be <br />granted. <br />2) Assistant Law Director Carole Heyward requested he report on the following items: <br />• She is preparing a real property maintenance initiative that she will be presenting <br />to the administration shortly. Some members of Council, the BZD chairperson <br />for example, is trying to take a comprehensive look at all types of real property <br />issues and possible remedies with respect to those. <br />• One complaint is pending before the Fair Housing Boazd involving a <br />condominium association. The association has prepared a proposed plan for <br />parking to address handicap issues at the location. She will present this plan to <br />the Fair Housing Board. <br />• On April 24, she pazticipated in a panel discussion at Cleveland Mazshall College <br />of Law attended by the Mayor and Councilwoman Nicole Dailey Jones on the <br />subject of how municipalities can increase the effectiveness of their fair housing <br />ordinances. <br />3) The Law Dept. hired two clerks for the summer-Trish Geraghty and Amy Chaho. <br />Last Friday was the last day for Heather Hemerlein who was the law clerk who assisted <br />the City Prosecutor and did a great job. We are sorry to see her go. <br />Finance Director Copfer: 1) She has been busy with FOP negotiations. Also, the team <br />started preparing contracts for AFSCME Service and ClericaUTech. The first session <br />with AFSCME Service was held today. <br />2) Springvale mini-bond issue-private placement at National City-came in lower than <br />what we had locked in our ceiling at because rates did go down somewhat. The city <br />saves $120 in interest. <br />3) Attended a meeting of Finance Directors at Rocky River Municipal Court on <br />Thursday, May 10. This yeaz, fines are down compared to last year. They are watching <br />expenses closely so they will not exceed their resources. There were some payments that <br />were required to be made-the exception for people retiring or made in lump sums so it <br />will even out for the rest of the year. She notified the court that for five months of 2007, <br />we are at 33% of our estimates, which we estimated less than what we got last year. If <br />fines were ratably collected, it should be at 42%. Therefore, she made it very clear, since <br />North Olmsted is the largest contributor to that court, they better be looking at ways to <br />3 <br />
