Council Minutes of 5/15/2007 <br />LEGISLATION <br />Resolution No. 2007-7 introduced by Mayor O'Grady was given its second reading. A <br />resolution authorizing the Director of Public Service to advertise for bids for the <br />replacement of the existing sound system (with allowance for future video recordings) in <br />Council Chambers and for the construction of a sound system in the new Council caucus <br />room; further authorizing the Mayor, subject to award by the Board of Control, to enter <br />into a contract with the lowest and best bidder, and declaring an emergency. Councilman <br />Barker moved for suspension of the rule requiring three readings as the legislation has <br />been discussed in committee, and the motion was seconded by Council Member Jones. <br />Roll call: Barker, yes; Jones, yes; Miller, no; Gareau, yes; Ryan, no; Orlowski, no. The <br />motion failed with three yes votes and three no votes. Mayor O'Grady asked what the <br />objection was. Councilman Ryan explained too often legislation is being pushed through <br />with less than three readings. He believes there is no rush to judgment on this and it can <br />go to three readings. <br />Ordinance No. 2007-48 introduced by Mayor O'Grady was given its second reading. An <br />ordinance authorizing the transfer of certain moneys in the city's Sewer Bond Retirement <br />Fund (Fund 460) to its General Obligation Bond Retirement Fund (Fund 410). <br />Councilman Miller moved for suspension of the rule requiring three readings, and the <br />motion was seconded by Councilman Barker. Roll call: Miller, no, with comment. In <br />light of the comments made by Mr. Burns this evening, he is voting no so it can go back <br />to committee for further discussion. Roll call continued: Barker, yes; Gareau, no; Ryan, <br />no; Jones, no; Orlowski, no. The motion failed with five no votes and one yes vote. <br />Councilman Gareau made a motion to refer Ordinance 2007-48 back to the Finance <br />Committee. The motion was seconded by Councilman Ryan and passed unanimously. <br />Ordinance No. 2007-50 introduced by Council Member Tallon behalf of himself and <br />Council Members Orlowski and Ryan was given its second reading. An ordinance <br />amending Section 103.03 ("Official Seal") of the Administrative Code in order to require <br />all city vehicles, except for unmarked Police vehicles, to prominently display the official <br />city seal. <br />Ordinance No. 2007-52 introduced by Councilman Orlowski was given its second <br />reading. An ordinance amending Section 505.15 of Chapter 505 (Animals and Fowl) of <br />the General Offenses Code, entitled "Keeping, Maintaining and Feeding of Wild <br />Animals," in order to prohibit displaying, maintaining or in any other manner keeping <br />wild animals at temporary events or retail stores in the City of North Olmsted, and <br />declaring an emergency. <br />Resolution No. 2007-53 introduced by Mayor O'Grady was given its second reading. A <br />resolution authorizing the Director of Planning to proceed with negotiations for the sale <br />of city-owned real property on Lorain Road identified as Permanent Parcel Number 237- <br />09-003 and known as the former site of the Pine Tree Beverage store, and further <br />authorizing the Mayor to enter into a contract to sell the real property. Councilman <br />Miller moved for suspension of the rule requiring three readings and noted the legislation <br />had been reviewed by committee and reported out.
