Council Minutes of 5/1/2007 <br />LEGISLATION <br />Ordinance No. 2007-20 introduced by Councilman Gareau was given its third reading. <br />An ordinance amending Section 1126.11 (Deviations From Approved Plans Prohibited) <br />of Chapter 1126 of the North Olmsted Zoning Code in order to require that developers <br />certify that site development plans and building elevations submitted to the city Building <br />or Engineering Departments incorporate all requirements of the final development plan <br />approved by City Council. Councilman Gareau moved for adoption, and the motion was <br />seconded by Councilman Orlowski. Roll call: Gareau, yes; Orlowski, yes, with <br />comment. This is a good, reasonable ordinance which requires as approved plans to be <br />submitted as final plans. He believes the real problem is an internal administrative <br />problem where individuals with authority are not exercising their authority in accordance <br />with the responsibilities which come with their respective departments and positions. <br />There appears to be no accountability for what transpires in the problems which are <br />occurring. There seems to be no concrete attempt to solve the problems, and he is not <br />sure this ordinance will solve the problem if there is no follow-up by the administration. <br />Roll call continued: Tallon, yes; Ryan, yes; Barker, yes; Jones, yes; Miller, yes. The <br />motion passed unanimously. Ordinance No. 2007-20 adopted. <br />Mayor O'Grady said he wished to go on record as stating the administration's strong <br />objections to the comments of Mr. Orlowski. If he has specific examples to share, the <br />administration would welcome them. <br />Resolution No. 2007-34 introduced by Councilman Orlowski on behalf of himself, <br />Mayor O'Grady and Councilman Barker was given its third reading. A resolution <br />authorizing the Mayor of the City of North Olmsted to file an application with the Ohio <br />Historical Society, at the request of the Landmarks Commission and in cooperation with <br />the Olmsted Historical Society, for an Ohio historical marker for Springvale Ballroom. <br />Councilman Orlowski moved for adoption. The motion was seconded by Councilman <br />Barker and passed unanimously. Resolution No. 2007-34 adopted. <br />Ordinance No. 2007-35 introduced by Mayor O'Grady was given its third reading. An <br />ordinance amending Section 957.01 of Chapter 957 (Alcoholic Beverages on Public <br />Grounds) of the Codified Ordinances of the City of North Olmsted in order to permit <br />alcohol to be sold and consumed at North Olmsted Park in conjunction with the 2007 <br />AFL-CIO Labor Day Parade. Councilman Orlowski moved for adoption, and the motion <br />was seconded by Councilman Tallon. Roll call: Orlowski, yes; Tallon, yes, with <br />comment. In a recent newspaper article, he requested that residents contact him if they <br />had any either pros or cons in regards to this issue. He stated his reasons for supporting <br />the issue. He received one phone call for the issue. Seeing no objection, his vote is yes. <br />Roll call continued: Miller, yes, with comment. This is a difficult decision for hirn to <br />make. As he indicated at the last meeting, there is nothing that probably belongs to the <br />people more than their library, their parks or their churches. We have been advised by <br />people who have attended regularly and who have run this parade that there have been no <br />incidents. There is a track record with this. In light of that track record, he hesitantly <br />supports it. However, he will make it clear that he believes that this issue of alcohol in <br />the park on a long-term basis should be brought to the voters to let the people decide. <br />9 <br />
