City Council Minutes of 2/26/2007 <br />Service Director Limpert commented that drainage has always been. a problem in this <br />area of Cuyahoga County. That is why the original. farmers put in drain tiles. When the <br />developments came in, those drain tiles got torn out. He has had his foremen looking at <br />this situation to see what can. be done. He will work with the Law Director to determine <br />what the city's legal. responsibility is for backyard drainage <br />Councilman Orlowski said the properties are sloped. towards the back. The drains should <br />carry surface water aut of the area. The properties drain to the surface drains and create <br />lakes in the residents' yards. The pipes need to be cleaned out. This is only the second <br />tine in 30 years the residents have asked. for help. He thinks there is an easement and. <br />feels the city would be able to go back. and clean out the drains. <br />LEGISLATION <br />Ordinance No. 2005-165 introduced by Mayor O'Grady was given its third reading. An <br />ordinance amending Chapter 149 of the Administrative Code ("Planning Commission"), <br />repealing Chapter 1125 of the Zoning Code ("Architectural Review Board"), and <br />amending Chapter 1126 of the Zoning Code (Commercial and Other Building Permits), <br />in order to effectuate the affirmative vote of the North Olmsted electorate at the <br />November 2005 general election upon Issue 97 (Charter amendment proposal relating to <br />new Planning & Design Commission) as amended. Councilman Gareau moved for <br />adoption. The motion was seconded by Councilman Miller and passed unanimously. <br />Ordinance No. 2005-165 adopted. <br />Ordinance No. 200b-122 introduced by Mayor O'Grady was given its third reading. An <br />ordinance amending Section 1139.01 of the Zoning Code in order to eliminate the <br />locational and density requirements for pet stores and animal hospitals in General Retail <br />Business Districts as amended. Councilman Gareau moved for adoption, and the motion <br />was seconded by Councilman Miller. Roll call: Gareau, yes; Miller, no; Barker, yes; <br />Orlowski, no; Jones, yes; Ryan, no; Tallon, no. The motion failed with three yes votes <br />and four no votes. Ordinance No. 2006-122 not adopted. (Ordinance No. 2006-122 was <br />reconsidered. Please see discussion at the end of the Legislation section.) <br />Ordinance No. 2006-164 introduced by Mayor O'Grady was given its third reading. An <br />ordinance providing for the amendment of the Zone Map of the City of North Olmsted by <br />rezoning Permanent Parcel Numbers 233-06-001, 233-06-002, 233-Ob-003, 233-06-004, <br />233-06-005, 233-06-006, 233-06-007, 233-06-008, 233-06-019, 233-06-021, 233-07-002, <br />233-07-003, 233-07-009, 233-07-025, 233-07-028, 234-OS-004, and 234-06-006, located <br />in the Barton-Bradley Roads area, from their respective current zoning classifications of <br />Limited Industrial, Mixed Use, Single Family Residence and/or Multiple Residence, <br />some of which are split-zoned, to the new Residential Office District classification as <br />amended. Councilman Gareau moved for adoption, and the motion was seconded by <br />Councilman Miller. Roll call: Gareau, yes; Miller, yes; Ryan, no; Barker, yes; Jones, yes, <br />with comment. This was a difficult decision for her to make as she had heard for many <br />months from residents on both sides of this issue. Many of the residents have had to <br />endure different zoning changes in this area for years. They're happy with the current <br />11 <br />.•~ <br />
