Council Minutes of 11/18/2008 <br />LEGISLATION <br />Ordinance No. 2007-58 introduced by Councilman Gareau was given its third reading. <br />An ordinance amending Section 339.02 of Chapter 339 of the North Olmsted Traffic <br />Code, entitled "Commercial and Heavy Vehicles," in order to increase the penalties for <br />truck and other heavy vehicle traffic that illegally travel upon local streets not designated <br />as truck routes. Councilman Gazeau moved for adoption. The motion was seconded by <br />Councilman Barker and passed unanimously. Ordinance No. 2007-58 adopted. <br />Ordinance No. 2008-56 introduced by Mayor O'Grady was given its third reading. An <br />ordinance amending Section 1139.01 of Chapter 1139 (Business Districts) of the <br />Planning and Zoning Code in order to regulate the placement of charitable collection bin <br />storage containers in the General Retail Business District of the City of North Olmsted. <br />Councilman Barker moved for adoption, and the motion was seconded by Councilman <br />Kearney. Roll call: Barker, no; Kearney, yes; Mahoney, yes; Gazeau, no with comment <br />that passing this legislation would permit charitable bins to be placed throughout the city <br />of North Olmsted. In the event the legislation does not pass, it would go back to what is <br />a prohibited placement within the city of North Olmsted and we would see them go the <br />way that he thinks they should, which is out. We have plenty of available bins by which <br />to deposit recyclable materials within the city. Just yesterday he saw in Westlake a <br />mound of debris piled up next to one of these very same bins. He votes no with the <br />understanding that, should the ordinance fail, we will revert back to what it currently was <br />before this legislation was introduced and that is a simple prohibition. His vote is no. <br />Roll call continued: Ryan, no; Orlowski, no; Jones, yes with comment that she believes <br />the best way to handle how many containers are placed in our city is through strict <br />regulation and not through banning. The motion failed with four no votes and three yes <br />votes. Ordinance No. 2008-56 was not adopted. <br />Ordinance No. 2008-57 introduced by Mayor O'Grady was given its third reading. An <br />ordinance amending Sections 7SS.11 and 7SS.12 of Chapter 7SS (Secondhand Dealers) of <br />the Business Regulation Code, entitled "Hours and Circumstances of Sales," and <br />"Exceptions" in order to regulate outdoor collection receptacles on commercial property. <br />Councilman Barker moved for adoption, and the motion was seconded by Councilman <br />Gareau. Roll call: Barker, yes with comment that this legislation is a back-up legislation <br />to 2008-56. His vote is no. Mr. Barker apologized for first saying yes as he meant to say <br />no. Roll call continued: Gazeau, no; Jones, yes; Kearney, yes; Mahoney, yes; Orlowski, <br />no; Ryan, asked for the count. President Kennedy said it was three, three. Mr. Ryan <br />voted no. The motion failed with four no votes and three yes votes. Ordinance <br />No. 2008-57 was not adopted. <br />Ordinance No. 2008-135 introduced by Councilman Gareau and Mayor O'Grady was <br />given its third reading. An ordinance amending Section 1333.01 of the Building Code in <br />order to more effectively require debris and other materials to be removed from <br />demolition sites, as amended. Councilman Gareau moved for adoption, and the motion <br />was seconded by Councilman Barker. Roll call: Gareau, yes with comment. He can <br />give three examples where in the past a demolition took place and the parcels were <br />improved, they were graded, and grass was planted.
