N/ ~A, <br />Council Minutes of 6/17/2008 <br />16) Mr. Barry Boehnlein has retired from our WWTP. We thank him for his 30 years of <br />service to our community, and we wish him well. <br />17) The county will soon be closing the Lewis Road bridge in the Metropazks for a <br />reconstruction which is expected to last about a year. <br />18) Construction of existing Stearns Road is expected to conclude by the end of July. <br />The south side of Lorain Road will have concrete poured this Thursday, during which <br />time traffic will be limited to one lane. The north side of Lorain Road should be <br />completed by late August with all landscaping and other wrap-up completed by the end <br />of September. <br />Law Director Dubelko: 1) Law Dept. has hired a new law clerk, Danja Therecka, who <br />will work with him and Assistant Law Director O'Malley on civil law reseazch. <br />Prosecutor Gordillo is interviewing for a law clerk to assist him in his work at Rocky <br />River Municipal Court. <br />3) Prepared a memo for the Charter Review Commission and attended its last meeting to <br />advocate for two proposed amendments to the City Charter that were sponsored by <br />Councilman Mahoney. He looks forwazd to the opportunity to address the issue again <br />when it is heard by Council's Intra-Governmental Relations Committee. <br />4) On June 10, received a public records request from the Westlife regarding the proposal <br />to construct a new Rec facility in the city. He is in the process of gathering records and <br />reviewing records to provide a response. <br />5) Litigation items: <br />• City of North Olmsted v. International Association of Fire Fighters, a case <br />sometimes before Judge Sutula and also the Court of Appeals, has had another <br />ruling. Last Council meeting, he had reported that the Court of Appeals had sent <br />the matter back to Judge Sutula to rule on a couple of post judgment motions and <br />then had given him additional time to complete that task. The judge has ruled, and <br />he did formally deny the city's motion to vacate. He also in part granted the <br />union's combined motion for sanctions and for pre judgment interest. We <br />received another ruling yesterday containing a revised final order in which the <br />judge revised the judgment entry from which we had initially filed our motion to <br />vacate, which he had denied. In his revised order, he granted the city the relief <br />sought by changing some of the language in the order that the city felt could be <br />confusing and could interfere with the parties contractual rights under the new <br />collective bargaining agreement for 2007-2008. He is happy about that most <br />recent order and thinks everything will be clarified as our appeal continues now <br />back to the Eighth District Court of Appeals. <br />• Pending labor arbitration before arbitrator Harry Graham involving a comp time <br />issue in the city's Fire Dept., the grievance has been withdrawn by the union with <br />the understanding the city would pay the arbitrator's cancellation fee. That has <br />been done, and the matter has been resolved with no award against the city. <br />Councilman Ryan requested from the Law Director a copy of a memorandum he wrote <br />several years ago regarding a proposed Charter amendment to eliminate the position of <br />Council President. The Law Director will provide a copy to Mr. Ryan. <br />3 <br /> <br />
