Of the three scenarios, the third one is the one with <br />the most level of certainty. Mr. Gazeau said this is a very difficult position he put myself <br />into three years ago. Of the three, not one of them is perfect. It was also stated that the <br />seals and latches for the doors with the new booths are entirely different than what is <br />presently being used, and in the near future the paint being used will be latex based <br />versus oil based, which hopefully will also contribute to less odor. Time frame for <br />construction without paper work would take about three months. The committee voted <br />2-1 to recommend extension of the temporary conditional use permit for two years and <br />noted everything would be completed, testing and approval by city officials, before any <br />further action. The dissenting vote was Mrs. Jones. The BZD meeting was adjourned at <br />8:33 p.m. <br />Councilman Barker read a letter from Councilman Kearney regarding this issue: "Due to <br />my son's graduation, I am unable to attend tonight's City Council meeting. I have asked <br />Councilman Bazker to read my statement on the body shop situation. This Council <br />approved the location for Suburban. I know it has brought headaches and hardships for <br />the business, the City Council, and especially the homeowners in the neighborhood. <br />Given the fact that Mr. Papotto is willing to invest more than a quarter of a million <br />dollars to try and remedy the situation, I believe he should be given the two yeaz <br />extended permit. If we as a Council fail to pass this and there is litigation and the city <br />loses in court, the business may be able to carry on at the location without the $250,000 <br />improvements. With the new system and exhaust fans being moved 80 feet away from <br />the homes, I believe and hope that all parties will be satisfied. Thank you for your time, <br />Kevin Kearney" Councilman Barker said he had also received a phone message from <br />Melissa Meredith, President of the Homeowners Association, regarding the Suburban <br />issue. Her message was that the residents are cautiously optimistic that it may improve <br />the situation and that the extension of the temporary use permit should be approved. <br />Councilman Bazker made a motion to extend the temporary conditional use permit for <br />Suburban Collision Center located at 26618 Brookpazk Ext. for a period of two years for <br />the purpose of installing of two (2) new Garmat USA paint booths and to replace three <br />preparation stations. Law Director Dubelko questioned when the two years would begin <br />and said that it would be fine to use June 3. Councilman Barker agreed that the two years <br />would begin to run from June 3, 2008. The motion was seconded by Councilman <br />Gareau. Roll call: Bazker, yes; Gazeau, yes; Orlowski, yes; Mahoney, yes; Ryan, yes <br />with comment that he was originally very opposed to Suburban being placed there. He <br />lost the vote, but he thinks at this point in time the practical side is to recognize that the <br />business is there and an awful lot of money has been invested. Unfortunately, this is in <br />his ward, and he knows what the people have gone through there; it's a terrible situation. <br />But it's come to the point that, with the kind of investment being made, he can see that <br />we are just going to have to continue down the path and wrap this thing up.
