This was a 20- <br />year project; and, within six months of being installed, there were cracks appearing in the <br />roadway. Mr. Klimkowicz agreed and said that Engineer Dan Collins could tell ODOT <br />how to fix it. He could tell them how to fix it. Mr. Gazeau commented that the sad part <br />is the city has to spend money to crackseal it to protect the asset in which we have <br />invested and have to live with for 20 years. If we don't do the maintenance, ODOT will <br />not provide more money for repairs. <br />LEGI~LATIQN <br />Ordinance No. 2008-17 introduced by Mayor O'Grady was given its third reading. An <br />ordinance amending Sections 1139.01, 1145.01, and 1145.03 of the Zoning Code in order <br />to establish regulations providing for the location of recycling facilities and recycling <br />collection centers in the City of North Olmsted as amended. Councilman Bazker moved <br />for adoption, and the motion was seconded by Councilman Gareau. Roll call: Barker, <br />yes; Gareau, yes; Jones, yes; Ryan, no; Orlowski, no with comment that he has <br />considerable experience with recycling facilities and believes they belong in our <br />Industrial Pazk District. They do not belong in a General Retail District. He believes this <br />will convey the wrong message or image of what we want in our city. Roll call <br />continued: Kearney, yes; Mahoney, yes. The motion passed with five yes votes and two <br />no votes. Ordinance No. 2008-17 adopted. <br />Ordinance No. 2008-19 introduced by Councilman Ryan and Councilman Orlowski was <br />given its second reading. An ordinance amending Section 505.08 of Chapter 505 of the <br />General Offenses Code entitled "Animals and Fowl," in order to restrict the number of <br />dogs that maybe kept on residential lots in the city, as amended. <br />Ordinance No. 2008-44 introduced by Mayor O'Grady was given its second reading as <br />twice amended. An ordinance amending Section 1351.99, 1363.07, 1363.08, 1363.10 <br />and 1363.99 of the Property Numbers and Real Property Maintenance chapters in order to <br />promote efficiency, clarify when seazch wazrants are required and increase the penalties <br />for property maintenance violations; and declaring an emergency, as twice amended. <br />Councilman Barker moved for suspension of the rules requiring three readings noting the <br />legislation had been reviewed in committee many times. The motion was seconded by <br />Council Member Jones. Roll call: Barker, yes; Jones, yes; Mahoney, yes; Orlowski, no; <br />Kearney, yes; Gazeau, yes; Ryan, yes. The motion passed with six yes votes and one no <br />vote. Councilman Bazker moved for adoption, and the motion was seconded by Council <br />Member Dailey Jones. Roll call: Barker, yes; Jones, yes with comment that amendments <br />made to our Real Property Maintenance Code are needed. The majority of her resident <br />complaints are property maintenance related; and, of those calls, the number of follow-up <br />calls from people wondering why the city is not moving faster to remedy the situation is <br />high. The changes made in the code are a reflection of what some Council members, the <br />administration, and some residents have been asking for for years: to become more <br />efficient in the azea, to protect our property values. Our code amended remains fair. Roll <br />call continued: Ryan, no; Kearney, yes; Orlowski, no; Mahoney, yes; Gazeau, yes. The <br />motion passed with five yes votes and two no votes.
