Council Minutes of 4/15/2008 <br />16) Crocker/Stearns construction is continuing along the west side of Stearns Road. A <br />temporary lane will be constructed on the north side of Lorain at that intersection to help <br />pass traffic during the intersection reconstruction. <br />17) Replacement of I-480 sound walls that were removed last year will begin soon. <br />ODOT will be using the interchange infield area along I-480 as a staging ground. <br />18) Asphalt plants are scheduled to be opened on Apri121 for hot patch, and repair of our <br />city streets will begin soon. <br />19) Bid books for the 2008 asphalt recycling and overlay projects are available in the <br />Service Dept. Bid opening is at noon on Apri130. <br />20) Regarding the Recreation Plan that was submitted by the administration and heard in <br />Council's Recreation Committee, he dots not feel that hearing individual elements of the <br />plan in various committees rather than keeping the discussion in one place is good <br />government. It is his belief this will only confi~.se the issue and confuse our populace. <br />Neither he nor the Finance Director will attend that meeting. If Council Members have <br />any question with regard to taxation or anything else, please feel free to contact the <br />administration. <br />Law Director Dubelko: 1) Would echo somewhat the Mayor's final comments and <br />approach it a little bit differently. This is one of the reasons why he believes that North <br />Olmsted should move in the direction of giving more authority to the President of <br />Council to control which committees discuss which city business. Under the current <br />rules, Councilman Ryan is entirely within his power to schedule a meeting and link the <br />subject matter of the proposed tax increase and the Rec Center to infra-governmental <br />matters. Possibly other committees could find a connection too, and there's a potential <br />for seven separate committee meetings on different pieces of this issue. He thinks good <br />government in North Olmsted requires that the President of Council have more authority <br />to deal with issues like this. <br />2) On April 2, met with attorney Panza on the Suburban Auto matter regarding the <br />temporary conditional use permit. It has been a temporary conditional use permit since <br />early 2006. They had a fiuitful discussion with our expert present. Since that time, our <br />expert has made a proposal for the city which he plans on discussing with the Safety <br />Director regarding what our expert believes. should be done at that facility to start us on <br />the path to finding a resolution to the nwisance odor complaints and to encouraging the <br />owner to implant certain changes and then retest. Hopefully, everything goes well and <br />we eventually lead to the conditional use permit that none of us expected would take this <br />long to get to when Council voted on it actually two and a half years ago. <br />3) Legislative items before Council tonight: Ordinance 2008-44, the real property <br />maintenance code. He has made the final change in that legislation that he brought up at <br />the committee meeting and the Law Dept. is satisfied that the legislation is in a form that <br />is ready for Council's final action. Ordinance 2008-49, the salary range ordinance, he <br />worked with the Finance Director in tailoring the longevity language, that which will <br />change longevity for all non-bargaining unit employees and eliminate it for full-time <br />elected officials effective next term. <br />4) Litigation: The fire fighter arbitration awards were discussed in executive session at <br />the caucus meeting. There have been a couple of motions filed in court and some action <br />being taken by the city in response to those motions. With respect to Suburban Auto, on <br />3 <br />
