Council Minutes of 3/18/2008 <br />3) On March 12, reviewed and approved the new golf cart supply lease agreement for <br />Springvale. <br />4) Safety and Law held a meeting on March 13 with our expert from Auburn <br />Environmental regarding Suburban. He communicated with attorney Kolick representing <br />Suburban following that meeting. Essentially, Suburban would like to use our expert to <br />assist in resolving the odor problems at their location. The city is willing to do that, but <br />only under certain circumstances with certain assurances so we know we have a good <br />process going forward. On a related matter regarding odor problems at this property, in <br />Asst. Law Director O'Malley's litigation report, he notes that, with the cooperation of the <br />Safety Dept., the police have been investigating odor complaints as per the nuisance odor <br />legislation recently passed by City Council. One complaint with regard to this property <br />was filed in Rocky River Court on March 6 and is set for initial appearance on March 18. <br />Both issues with this property, one dealing with assuring that our criminal ordinances are <br />in force and the other dealing with the civil side of the conditional use permit process, are <br />being worked on. <br />5) From March 13 to March 18, he spent a considerable amount of time working on <br />Councilman Orlowski's legislative request for nuisance property legislation, which he <br />thinks has the potential to be very good legislation. He continues to work with the <br />Councilman and is also getting input from Safety and police. <br />6) On March 18, responded to a public records request from an unsuccessful law firm <br />regarding his outside counsel RFP process. <br />7) In the case of Szarka v. Board of Zoning Appeals, the record in that case was <br />transmitted to the Court of Appeals on March 5. The appellants' brief is due on or about <br />March 25. Therefore, the city's appellee's brief is due on or about April 14. <br />Finance Director Copfer: 1) Thanks to Council and the administration for the eleventh <br />budget process that she has been through with the city as the Finance Director. This was a <br />very pleasant experience, which didn't start out that way as it was a very difficult budget <br />process-creating it and balancing it. But the process was very professional. People had <br />time to really look at the information provided. Every Council person had lists of <br />questions; and, as the directors were making presentations, she could tell they were <br />checking off their questions that were getting answered. She thinks everyone respected <br />each other's roles and responsibilities. Thanks to chairman Gareau for leading everyone <br />in the process, and she looks forward to making sure this budget works for the city. <br />Councilman Gareau, chairperson of the Finance Committee: 1) The Finance Committee <br />met on Tuesday, March 12, 2008 at 7:06 p.m. Present were committee members Gareau, <br />Kearney and Barker; Council Members Mahoney, Orlowski, Jones and Council President <br />Kennedy; Finance Director Copfer, Mayor O'Grady, Law Director Dubelko, Service <br />Director Limpert, Human Resources Director Farver, Planning Director Wenger. The <br />meeting ended at 9:30 p.m. There was a second meeting on Saturday, March 15, 2008 at <br />8:10 a.m. Present were committee members Gareau, Kearney and Barker; Council <br />members Mahoney and Orlowski; Finance Director Copfer, Mayor O'Grady, Human <br />Resources Director Farver, CLS Director Dailey and Safety Director Thomas. That <br />meeting ended at 12:35. On the agenda for both meetings was Ordinance 2008-34, an <br />ordinance to make appropriations for current expenses and other expenditures for the City <br />-, <br /> <br />
