Council Minutes of 11-17-2009 <br />members Brossard, Kearney and Orlowski; President Kennedy; Planning Director <br />Wenger; Law Director Dubelko; and guests. <br />1) The first issue discussed was CMS09-10 Ganley Subaru located at 25730 Lorain Road. <br />Representing Ganley Subaru was Mr. Robert Lisy, general manager of Ganley Westside <br />Imports. The project consists of constructing a new car dealership and site improvements. <br />The existing structure on the site will be demolished in order to accommodate the new <br />building. The building has been designed to best meet the required setbacks on this <br />irregularly shaped property. The building is a mix of split face black, metal panel, slate <br />veneer and storefront glass. The proposed bollards by the service area will incorporate <br />building colors. Landscaping is consistent with the materials and design proposed for <br />Ganley VW, The applicant has agreed to maintain the large existing tree on the site, and <br />care will be taken to ensure this tree is not damaged during the construction process. The <br />proposed new sidewalk is shown curved around the base of the tree to accommodate the <br />root system. Pavers will be installed in the right-of--way area. The applicant proposes <br />vinyl fencing adjacent to the residential property to tie into the fencing on the rest of the <br />Ganley property. The applicant may be considering offering the property behind the <br />fence for use by the neighboring residential property owners as they did during the V W <br />project. Whatever arrangement is worked out privately, the area between the fence and <br />the property line is the responsibility of the property owner for maintenance from the <br />city's enforcement perspective. The applicant received variances for signage and limited <br />display of inventory in the front setback. The lot consolidation process has begun but the <br />application has not yet been approved. A motion was made by Mr. Barker to approve <br />CMS09-10 Ganley Subaru located at 25730 Lorain Rd. pursuant to all recommendations <br />of the Planning and Design Commission and the motion was seconded Mrs. Dailey Jones <br />The vote was 3-0 to approve. <br />Councilman Barker made a motion. to approve CMS09-10 Ganley Subaru located at <br />25730 Lorain Rd. pursuant to ail reccomendations of the Planning and Design <br />Commission. The motion was seconded by Councilwoman Jones and passed <br />unanimously. CMS09-10 Ganley Subaru approved. <br />2) Next on the agenda was CMS09-09 Sovereign Grace Church located at 29047 Lorain <br />Road. This proposal consists of a request for a conditional use permit for a church in a <br />general business retail district. Representing Sovereign Grace was the Pastor Darren <br />Landes and representing Stearns Plaza was Mr. Randy Viviani. Chapter 1118 outlines <br />the general criteria and standards for review. Other than signage, the applicant is <br />proposing no changes to the exterior of the building. Therefore, the issue before City <br />Council is the conditional use permit standards and conditions. There is no development <br />plan review involved. The applicant is currently resolving a number of property <br />maintenance violations at the site. The parking lot is an issue that has been of particular <br />discussion with the Building and Engineering Departments. While the Planning and <br />Design Commission had significant concerns regarding the state of the property, they <br />were advised against tying any review or ruling related to the conditional use permit to <br />the existing property maintenance concerns. The conditional use permit general standards <br />and criteria should be applied to the use that is being proposed, not the existing <br />conditions of the site.
