Council Minutes of 10-06-2009 <br />negotiating team. Thank you to those teams, and the city will hopefully have speedy <br />resolution of the other bargaining units soon. <br />Law Director Dubelko: 1) There is a litigation update on the case of The City of North <br />Olmsted vs. Suburban Collision, a nuisance odor violations case pending in Rocky River <br />Court. The Court has ordered an extension of the diversion program until June 3, 2010. <br />This will make that diversion program's length to coincide with the expiration of the <br />conditional use permit that Council granted a year and a half ago. All those items will <br />come up for consideration and hopefully find a resolution in June of 2010. <br />2) In the probate case of Michael Stinn, Administrator of the Estate of Kenneth T. <br />Corneliusen vs Astrid Try, et al., there was a question of whether or not the descendant <br />had any heirs, and the city was joined as a party because funds would escheat to the city <br />if there were no heirs. The heirs have been located. It's a fairly good-sized estate and the <br />city received a substantial amount of estate tax. <br />3) The city has had two new real property cases referred to the Law Department since <br />September 1. A third case has been reviewed and it is awaiting filing and service. There <br />was one conviction in the month of September for trash and paint violation for <br />presentence investigation. Two cases were resolved in the month of September. One <br />was for paint and fence in Ward 3. There was a fine of five hundred dollars for each of <br />five counts for a total of a twenty five hundred dollar fine plus a suspended jail sentence. <br />The second was a trash and debris case, he believes, in Ward 4 on Columbia Road. There <br />was a fine of one hundred fifty dollars and a suspended jail sentence. The Building <br />Department and Law Department continue to do their best to enforce the property <br />maintenance codes in the city. <br />4) Regarding fair housing, Carole Heyward reports that HUD has completed and advised <br />the city of its performance assessment conducted at the end of July. The city received <br />notice on September 28 that it passed on the performance assessment. The city was <br />either evaluated or not evaluated because of non-applicability in all categories. The city <br />passed when evaluated, so it was a very good report from HUD. The program continues <br />to do very well as result of the efforts of Assistant Law Director Carole Heyward as the <br />Fair Housing Administrator and Chairperson Nicole Dailey Jones of the Fair Housing <br />Review Board. <br />5) City Prosecutor Mike Gordillo prosecuted a total of two hundred forty-two cases in <br />the month of September. One hundred of those were general offense cases. One hundred <br />forty-two were traffic. There were no trials and, therefore, no convictions. <br />Finance Director Copfer: 1) She attended various mediation and negotiation sessions <br />with the police, IAFF, and Clerical/Tech bargaining units. She attended the first meeting <br />of the Healthcare Committee as configured in the labor contracts on September 24 where <br />she participated as an advisor. <br />2) The August financial statements were E-mailed yesterday. She reviewed them and <br />noted that nothing is different. She didn't change any projections.
