.. Council Minutes of 10-06-2009 LEGISLATION Ordinance No. 2009-102 introduced by Councilmen Mahoney, Brossard, and Kearney was given its third reading. An Ordinance amending Section 331.42 of the Traffic Code in order to prohibit text messaging while operating a motor vehicle, and declaring an emergency, as amended. Councilman Mahoney moved for adoption. The motion was seconded by Councilman Kearney and passed unanimously. Roll Call: Mahoney, yes; Kearney, yes; Gareau, yes; Barker, yes with comment. I want to commend my colleagues for bringing this forth and putting up in front of North Olmsted along with not too many other communities in this state, and it looks like it's going to just snowball from here. Roll Call continued: Jones, yes; Brossard, yes; Orlowski, yes. Motion passed unanimously. Ordinance 2009-102 adopted. Resolution No. 2009-103 introduced by Councilman Mahoney was given its third reading. A Resolution canceling the current agreement, and authorizing the Mayor to enter into a new agreement, with the North Olmsted School District granting the school district a license to install and maintain a removable fence on Diamond Number One Baseball Field at North Olmsted Park, as amended. Councilman Mahoney moved for adoption. The motion was seconded by Councilwoman Jones and passed unanimously. Ordinance 2009-103 adopted. Ordinance 2009-104 introduced by Mayor O'Grady was given its second reading. An Ordinance to make and transfer appropriations for current expenses and other expenditures for the city of North Olmsted for the year ending December 31, 2009. Councilman Gareau motioned to suspend the rule requiring three readings noting it was reviewed in committee. The motion was seconded by Councilman Barker and passed unanimously. Council President Kennedy asked if there was anyone in the audience that would like to address Council with regard to this legislation. Councilman Gareau moved for adoption. The motion was seconded by Councilman Barker and passed unanimously. Ordinance 2009-104 adopted. Resolution 2009-105 introduced by Mayor O'Grady was given its second reading. A Resolution authorizing the Mayor of the city of North Olmsted to enter into atwo-year contract with Union Eye Care Center, Inc., to provide eye care and vision services to city employees in connection with the city's self-insured health care plan. Resolution 2009-106 introduced by Mayor O'Grady was given its second reading. A Resolution authorizing the Director of Public Service to advertise for bids for copy machine leases and service agreements, and further authorizing the Mayor, after Board of Control approval, to execute a contract with the lowest and best bidder, and declaring an emergency, as amended. Councilman Gareau motioned to suspend the rule requiring three readings noting it was reviewed in committee. The motion was seconded by Councilman Kearney and passed unanimously.
