.. <br />Council Minutes of 10-06-2009 <br />LEGISLATION <br />Ordinance No. 2009-102 introduced by Councilmen Mahoney, Brossard, and Kearney <br />was given its third reading. An Ordinance amending Section 331.42 of the Traffic Code <br />in order to prohibit text messaging while operating a motor vehicle, and declaring an <br />emergency, as amended. Councilman Mahoney moved for adoption. The motion was <br />seconded by Councilman Kearney and passed unanimously. Roll Call: Mahoney, yes; <br />Kearney, yes; Gareau, yes; Barker, yes with comment. I want to commend my <br />colleagues for bringing this forth and putting up in front of North Olmsted along with not <br />too many other communities in this state, and it looks like it's going to just snowball <br />from here. Roll Call continued: Jones, yes; Brossard, yes; Orlowski, yes. Motion passed <br />unanimously. Ordinance 2009-102 adopted. <br />Resolution No. 2009-103 introduced by Councilman Mahoney was given its third <br />reading. A Resolution canceling the current agreement, and authorizing the Mayor to <br />enter into a new agreement, with the North Olmsted School District granting the school <br />district a license to install and maintain a removable fence on Diamond Number One <br />Baseball Field at North Olmsted Park, as amended. Councilman Mahoney moved for <br />adoption. The motion was seconded by Councilwoman Jones and passed unanimously. <br />Ordinance 2009-103 adopted. <br />Ordinance 2009-104 introduced by Mayor O'Grady was given its second reading. An <br />Ordinance to make and transfer appropriations for current expenses and other <br />expenditures for the city of North Olmsted for the year ending December 31, 2009. <br />Councilman Gareau motioned to suspend the rule requiring three readings noting it was <br />reviewed in committee. The motion was seconded by Councilman Barker and passed <br />unanimously. Council President Kennedy asked if there was anyone in the audience that <br />would like to address Council with regard to this legislation. Councilman Gareau moved <br />for adoption. The motion was seconded by Councilman Barker and passed unanimously. <br />Ordinance 2009-104 adopted. <br />Resolution 2009-105 introduced by Mayor O'Grady was given its second reading. A <br />Resolution authorizing the Mayor of the city of North Olmsted to enter into atwo-year <br />contract with Union Eye Care Center, Inc., to provide eye care and vision services to city <br />employees in connection with the city's self-insured health care plan. <br />Resolution 2009-106 introduced by Mayor O'Grady was given its second reading. A <br />Resolution authorizing the Director of Public Service to advertise for bids for copy <br />machine leases and service agreements, and further authorizing the Mayor, after Board of <br />Control approval, to execute a contract with the lowest and best bidder, and declaring an <br />emergency, as amended. Councilman Gareau motioned to suspend the rule requiring <br />three readings noting it was reviewed in committee. The motion was seconded by <br />Councilman Kearney and passed unanimously.
