Council Minutes of 9/1/2009 <br />2) With respect to pending real property maintenance cases, there are 17 files in the Law <br />Department. Of those, 14 have been filed in Rocky River Court, or are somewhere in <br />between the Law Department and Rocky River Court. In the month of August, 4 of those <br />cases were pretty much resolved-1 with a plea and a fine. There were also 3 other pleas <br />in August, and those are pending pre-sentence investigation. Assuming those terminate <br />favorably, there will be 13 cases currently in the Law Department. <br />3) Prosecutor's report for the month of August: Prosecutor Mike Gordillo handled a total <br />of 213 cases in Rocky River Court; 116 of those were traffic; 97 General Offenses. There <br />were no trials last month. <br />Regarding the issue of Suburban Collision Center, Councilman Gareau said he recently <br />had occasion to speak with one of the residents adjacent to that property who had been <br />experiencing significant problems in the past. He told Mr. Gareau that he had little to no <br />problems this summer-he frequently used his backyard. In the past, there had been an <br />overwhelming odor of paint coming over the property line into his property. He was very <br />happy with the work the city has done. He was grateful for the work Mr. Papotto has put <br />into the property, and he said Mr. Papotto has gone above and beyond perhaps what <br />needed to be done. Mr. Papotto has worked well with the residents. The residents, to <br />their credit, have been extraordinarily patient. He can't say for sure, but it looks like the <br />problem may be solved. Congratulations to the administration on doing a good job, and <br />congratulations to the residents for their patience in working through this. <br />Regarding property maintenance, Councilman Barker thanked the Law Director and the <br />Law Department for their work. An issue in his Ward was recently resolved after a <br />resident was taken to court, given a fine, and probation. The resident is now doing yard <br />work on his property. Thanks to Assistant Law Director O'Malley for his efforts in <br />court. Law Director Dubelko said some of the problems get faster and better <br />resolutions-sometimes not as fast as you would like. But, when you have good people <br />on Council who are involved in it, and have the administration working on it, and have <br />residents who are patient and reasonable and rational, then usually we have the tools to <br />eventually get the problem solved. <br />Regarding Resolution 2009-85, the health care reform principles, Councilman Mahoney <br />asked if other municipalities have passed similar resolutions, either in our general area or <br />throughout Ohio. Mayor O'Grady answered that he did not know. But he knows that <br />municipalities throughout the United States have been approached on the subject and <br />asked to participate. He has never asked the question or surveyed who has done it. His <br />expectation certainly would be that it has been done. <br />Finance Director Copfer: 1) The second quarter review narrative was distributed to the <br />directors, Council and others 'on Friday. The July financial statements and stats tables/ <br />charts were sent to those people on Monday: <br />2) On August 25, she participated in negotiations with the Service union; on August 26, <br />with the Clerical/Tech union; today, mediation with the IAFF. <br />3) The Auditor of State released the 2008 audit report this past Friday. It is on the <br />Auditor of State's website and will be on the city website today or tomorrow. <br />3 <br />
