.tee,
~~,:
Council Minutes of 6/2/2009
capable of being salvaged. The settlement proposal was put forth to the Law Dept. after
they negotiated it. It was approved, and there was no objection from the Safety Director
who indicated in her writing she did not have a concern and agreed with the amount of
the settlement. The settlement amount was $20,321.12, which would require City
Council to execute a general release of all claims against the tortfeasor. After discussion
and presentation by the Director of Law and with the written comments of Safety
Director Dr. Thomas, a committee motion was made to recommend approval by
Councilman Gareau. It was seconded by Councilman Kearney, and the committee
recommended approval by a vote of 3-0.
Councilman Barker, chairperson of the BZD Committee: 1) At the last Council meeting,
Ordinances 2009-63 and 2009-64 were presented to City Council and then referred to the
Planning & Design Commission. These two pieces of legislation have to do with wind
turbines and an overlay district for wind turbines. Councilman Barker made a motion to
extend the time of 30 days that Planning & Design needs for notification and discussion
for Ordinances 2009-63 and 2009-64 to the date of August 25, which coincides with the
City Council public hearing. The motion was seconded by Councilman Kearney and
passed unanimously.
Councilman Mahoney, chairperson of the Recreation, Public Parks & Buildings
Committee: 1) The Recreation, Public Parks & Buildings Committee met on May 26,
2009 at 7:15 p.m. Present were committee members Mahoney and Brossard; Council
President Kennedy and Councilpersons Barker, Orlowski, Gareau .and Kearney; Law
Director Dubelko and Community Life Services Director Dailey. On the agenda was
Ordinance 2009-60, an ordinance authorizing the Mayor to renew the contract between
the city and Karrie Skall Tipton for the provision of professional gymnastics instruction
services at the North Olmsted Recreation Center for an additional two years. Comments
were made by Mr. Mahoney and Mr. Brossard as to their family experiences as both of
their daughters have enjoyed the program at the Rec Center run by Karrie Skall Tipton.
Community Life Services Director Dailey made a fine presentation on behalf of not only
the ordinance but also the program and the many accolades that have been achieved by
Mrs. Tipton. The committee voted 2-0 to recommend approval under suspension of the
rule.
2) The Recreation Commission met on Monday, June 1. Members of the Recreation
Commission include Councilman Mahoney as Council's representative, school board
representative John Lasko, Recreation Commissioner Ted DiSalvo, chairperson Terry
Groden, and citizen representatives Julie Nader, Chris Scarl, and Norm Baxter. Financial
reports and updates were given as to the overall status of the Recreation Department.
New wood fiber was installed to a 10 inch depth at the North Olmsted Park playground
on May 29. That replaces and vastly improves the condition of the play surfaces at the
Park. The wood fiber is ADA compliant, and Commissioner DiSalvo's estimate is we
won't need to redo that particular surface for approximately three years. He and all the
members of the Recreation Dept. are very satisfied with that work. The summer camp
begins Monday, June 8; the outdoor pool opens on June 15. In regards to the process of
collecting quotes for the Barton-Bradley playground equipment that is being replaced and
the new surface, Mr. Dailey reported that the contract will be under $25,000.
