CITY OF NORTH OLMSTED <br />ORDINANCE N0. 80- 93 <br />PACE 3. <br />In the event the office of Director of Law shall become <br />vacant for any reason, the Mayor shall appoint a successor, subject <br />to confirmation by a majority of the members of Council, to serve <br />for the unexpired term or until the election of a successor for the <br />unexpired term at the next regular municipal election provided that, <br />(a)such election shall occur more than two (2) years prior to the <br />expiration of the unexpired term, and (b) the vacancy shall have <br />occurred more than seventy five (75) days prior to the date for <br />the primary election. If such. vacancy occurs after the filing date <br />the Mayor shall appoint a successor, subject to confirmation by a <br />majority of the members of Council. <br />Upon concurrence of two-thirds of the members of Council, <br />the Council may, after public hearing, remove the Director of Law <br />from office for his disqualification while in office, for his con- <br />viction while in office of a crime 'involving moral turpitude, or <br />for a violation of his oath of office. Prior to such. removal action, <br />the Director of Law shall be notified in writing of the charge or <br />charges against him at least ten (10) days in advance of any hearing <br />upon such charge or charges, and he and his counsel shall be given <br />an opportunity to be heard, present evidence, and examine any <br />witnesses appearing in support of such charge or charges. <br />The Director of Law shall act as legal counsel and serve <br />~n such_capacty the Mayor, Council, administrative officers, <br />departments, and the commissions and boards of the City. As legal <br />counsel and attorney, he shall represent the City in all proceedings <br />in court or before any administrative body and in such other matters <br />and controversies as he is, by resolution or ordinance, directed to <br />prosecute. The Director of Law may with the approval of a majority <br />of the members of council retain the services of outside counsel <br />to assist him in carrying out any of duties specified in this <br />Section. He or an Assistant Director of Law shall act as Prosecuting <br />Attorney for the City. He shall perform all other duties now or <br />hereinafter imposed upon city solicitors by the laws of the State <br />of Ohio unless otherwise provided by ordinance of the Council and <br />shall perform such duties as Council and the Mayor may impose upon <br />him consistent with his office. <br />Proposal 4: That Section 4 of Article V of the Charter <br />relating to the advisory commission appointed by the Director of <br />Public Safety be amended to eliminate such advisory commission, <br />such amended Section 4 of Article V to read as follows: <br />ARTICLE V <br />ADMINISTRATIVE OFFICERS AND DF.PARTP.~ENTS <br />SEC. 4. DEPARTMENT OF PUBLIC SAFETY. <br />The Director of Public Safety shall have charge of the <br />Department of Public Safety. He shall make all necessary rules <br />and regulations for the government of the Department and the divisions <br />thereof. He shall not hold any other elective or appointive office <br />or other full-time employment, public or private. He shall be <br />charged with the duty of enforcing all police, fire, safety, health, <br />sanitary, and building regulations that may be prescribed by ordinances <br />or rules of the City or, when applicable, the general laws of Ohio. <br />He shall be charged with the responsibility of developing, operating <br />and maintaining parks and recreation facilities and programs for the <br />City, and of initiating and coordinating efforts to prevent crime <br />and delinquency. He shall perform such other duties consistent with <br />his office as may be required by this Charter, by ordinance of the <br />Council, or as directed by the Mayor. <br />
