Furthermore, all <br />sworn Police Officers, except the Chief of Police, shall receive additional <br />four (4) hours straight time pay if required to work eight (8) hours or more <br />on Thanksgiving and Christmas or receive compensating time off if approved <br />by Chief of Police. <br />I. That all full-time employees of the Police Department shall be en- <br />titled to an annual vacation in accordance with the City of North Olmsted <br />Vacation Ordinance. <br />J. That for purposes of this Ordinance a work day is defined as a <br />continuous eight (8) hour period and a work week is defined as forty (40) <br />hours. <br />K. That effective January 1, 1977, all full-time sworn employees with <br />the exception of the Chief, the City of North Olmsted shall pay employees <br />time and a half (12) their regular rate of pay for all hours required to be <br />worked in excess of the work day or week as defined in Paragraph J hereof. <br />However, no employee shall be paid at an overtime rate for time spent while <br />pursuing educational endeavors, mandatory schooling required by law or <br />internal programs instituted by the Chief of Police relating to changes in <br />Revised Code or the Ohio Uniform Rules of Criminal Procedure. It shall, <br />however, be appropriate to pay the overtime rate to employees who participate <br />in specialty programs requiring training at times other than the employees' <br />regular tour of duty and further that said programs have been designated by <br />the Chief of Police as one for which the overtime rate will be paid. <br />L. Any employee who qualifies for overtime by virtue of the provisions <br />of Paragraphs J and K hereof shall be paid a minimum of two (2) hours when <br />required to report for extra duty over and above his regular work day and <br />work week. Said employee shall also be paid a minimum of two (2) hours for <br />appearances at the Rocky River Municipal Court and a minimum of four (4) <br />hours for appearances before the Grand Jury or Common Pleas Court when the <br />same is required and is at a time other than the employee's regular work <br />tour. The compensation for the aforesaid hours of credit will be at a rate <br />of time and one half (12) of the employee's regular rate of pay. <br />M. Any time a patrolman is required to temporarily take charge of a <br />shift command, said patrolman shall be paid a premium of one additional hour <br />at a straight time rate for each day he is required to do so. <br />N. In the event that a full-time sworn employee of the Police Depart- <br />ment of the City of North Olmsted should be injured while in the line of <br />duty due to a sudden and accidental occurence and such injury has so in- <br />capacitated said member of the Police Department that he is temporarily <br />unable to work, then the Director of Public Safety, after determining that <br />said injury is work related and is of a temporary nature, may authorize <br />full payment of the employee's regular salary for a period of not more than <br />ninety days. If, after said ninety day period, said employee is still tem- <br />porarily incapacitated, then the Director of Public Safety shall recommend <br />to Council whether or not to continue said salary. Council shall forthwith <br />review the matter and by majority vote dtermine whether the employee shall <br />continue to receive his full salary during recuperation. <br />For the purposes of this Paragraph, a sudden and accidental injury <br />shall include such incidents as an automobile accident, assault and battery, <br />gun shot wound and the like. It shall not be considered as sudden and ac- <br />cidental if injury or incapacity results from the lifting of objects, slip- <br />ping, tripping or falling, heart failure or heart attack. <br />Any full time sworn employee of the Department who qualifies for <br />benefits under Paragraph N hereof shall be required to pay over to the City <br />any amounts received from the Bureau of Workmen's Compensation as supple- <br />mental wages. Further, if at any time the City determines, on the basis <br />of medical evidence, that an employee is permanently disabled and will no <br />
