<br />ARTICLE 11 DISTRIBUTION OF OVERTIME <br />i 1.01 The Employer shall be the sole judge of the necessity of overtime. All overtime shall be <br />voluntary and an employee shall have the right to refuse any overtime assignment except for <br />emergencies. An "emergency" is defined as any impairments to City services or operations <br />which camlot be delayed until the begimling of the next regular work day. In non-emergency <br />situations, the City may require the least senior qualified employee in the classification who are <br />available, to perform the overtirrie work. The distribution of overtime shall be referred to the <br />Labor/Management Committee for discussion and resolution. <br />11.02 The Employer shall endeavor, insofar as it may be practicable, to make generally <br />equitable distribution of overtime work among employees within a classification and department <br />who are capable of performing the available work satisfactorily. Employees who are offered <br />overtime and for any reason refuse or fail to work shall be credited with the overtime as if they <br />had worked, for the purpose of overtime distribution. An employee who works overtime will be <br />credited only with the number of hours he actually worked. An employee who should have been <br />called up for overtime, but was missed, shall have deducted from his equalization the total <br />number of hours that were worked on that overtime call. In the event that a sufficient number of <br />qualified employees are not available within the classification for the overtime assignment, <br />qualified employees from a different classification and/or department shall be offered the <br />overtime work and the overtime opportunity shall be distributed as equitably as possible. The <br />Employer shall maintain lists by classification showing the overtime hours of each employee. <br />All overtime hours shall be recorded on a daily basis. The overtime lists shall be posted at each <br />work location (Service Garage, Plant and Systems) and shall be kept current on a daily basis. <br />The Service Mechanics and helpers will be subject to rotating overtime. These overtime lists <br />shall be reduced to zero and start again on July 1 sc of each year. Students, seasonal and part-time <br />employees will not work overtime until all regular employees have been offered overtime. <br />11.03 During snow season, employees will be canvassed daily to determine their availability <br />during the ensuing non-shift/overtime hours for snow removal or ice control duty. However, <br />employees who refuse voluntary overtime but ultimately would not have been called off the list <br />will not be re-credited with overtime hours worked. The overtime seniority list will be followed <br />and those employees not interested in being called will not be contacted on a subsequent call out <br />unless emergency conditions develop. <br />11.04 For the purpose of this section, there shall be an exception to the distribution of overtime <br />in accordance with the overtime procedure above. <br />1) The Employer may schedule an employee to work more than his regular <br />scheduled day not to exceed ten (10) hours in a week. <br />2) Once an employee has worked ten (10) hours the Employer shall offer <br />Overtime in strict accordance with the overtime provision above. <br />This section pertains to hold over only, all call outs shall remain in strict compliance with <br />the call out procedure contained herein. <br />
