The aforementioned boot allowance amounts shall be paid during the first pay period after July 151 each year of this agreement. 39.02 All mechanics, lead mechanics, and mechanic helpers shall receive a tool allowance in the amount of six hundred ($600.00) dollars in 2007 and seven hundred ($700.00) dollars in years 2008 and 2009, respectively. The aforementioned tool allowance shall be paid. at the same time as the boot allowance cited in Section 39.01 above. ARTICLE 40 INCLEMENT WEATHER 40.01 During periods of inclement weather, the Employer will attempt to schedule work that does not require extensive exposure to the elements. Inclement weather is defined to mean air temperature in excess of 100 degrees and air temperature below five degrees. During an "emergency" as defined within Article 11, Section 1 of this agreement, the provisions of Article 41, shall not be applicable. ARTICLE 41 FUNERAL LEAVE 41.01 A full-time employee shall be granted a three (3) day leave of absence with pay, in the event of the death of an immediate family member. 41.02 Immediate family shall include, spouse, children, step children, father, n~iother, brother, sister, brother-in-law, sister-in-law, mother-in-law, father-in-law, grandparents and grandchildren. 41.03 In the event of death of any other relative not listed above an employee shall use his accumulated sick leave or inay use sick leave to extend funeral leave time. Pursuant to Article 22, paragraph 22.04, one such absence per year shall not effect eligibility to bonus days. ARTICLE 42 COMMERCIAL DRIVER'S LICENSE 42.01 Employees in classifications which require a commercial driver's license (CDL) shall be required to maintain a CDL. Employees transferring into or promoting into these classifications shall have ninety (90) days to obtain a CDL. 42.02 The Employer shall pay the cost of the commercial driver's license, any endorsements to that license, and any testing necessary to obtain it for all new employees required to obtain the license to perform their duties, and all employees promoted to such positions. The Employer's obligation shall be limited to the first test an employee takes, and the Employer shall reimburse Employees the cost of the CDL, renewals and endorsements. The Employer agrees to pay the cost to renew all licenses. 42.03 In the event that an employee loses his CDL or is not successful in passing the CDL 27
