*•~, <br />""'`~ <br />The Agency may conduct on-site monitoring of a service(s) for which funds are being reimbursed <br />under this Agreement at any time during the normal working hours of the Contractor with no prior <br />notification necessary, and the Contractor agrees that representatives of the Agency shall be given <br />full access to the premises upon which such service(s) is being provided. <br />ARTICLE VII: RECORII MAINTENANCE ACCESSIBILITY' ANO RE'T'ENTION <br />7.1 To the extent authorized by law, the Contractor agrees to allow representatives of the <br />Agency and ODA and its Office of the State Long Term Care Ombudsman access to all <br />programmatic, fiscal, and other records related to the service(s) for planning, auditing, and <br />monitoring purposes at any time during the normal working hours of the Contractor with no <br />prior notification necessary, except that prior notice of at least 24 hours shall be given where <br />access is sought to the confidential complaint files of the Contractor. <br />7.2 The Contractor agrees to keep client information including but not limited to: name, address, <br />telephone number, date of birth, gender, minority status, disability status, emergency contact <br />person's name and telephone number, and functional abilities of client relevant to service(s) <br />delivered. <br />7.3 The Contractor agrees to document that service(s) were delivered in accord with the ODA <br />taxonomy of services and Agency clarifications to said taxonomy as well as the ODA <br />Service Specifications and Conditions of Participation and retain said documents for a <br />period of three years following the period of this agreement. <br />7.4 The Contractor agrees that said records shall be accessible to the Agency, except for the <br />names of complainants, of residents of long term care facilities, and of recipients of <br />community-based long term care services, and retained for a period of three years following <br />the period of this agreement. The Office of the State Long Term Care Ombudsman of ODA <br />shall have access to the complaint files of the Contractor. The Agency agrees that all <br />information contained in said records will be treated in accord with all applicable lelrislation <br />guaranteeing privacy, especially, the Older Americans Act Amendments of 1987. <br />ARTICLE VIII: PROBLEMS IN PROVISION OF SERVICES <br />8.1 The Agency will inform the Contractor in writing of any problems it notes in the provision <br />of the service(s). The Contractor shall respond in writing to the Agency within thirty (30) <br />calendar days after the sending of such notice informing the Agency of the corrective action <br />it will take in regard to each such problem, and stating when such corrective action will be <br />POS 5 of 14 <br />
