The Mayor or his designee, shall meet at a mutuafiy <br />agreed satisfacfary time with the Local Union Grievance committee to consider the <br />grievance wi#hin seven (7) working days following rsceipt af the appeal. A <br />representafive of Ohio Council 8 may participats in any such mseting. The Mayor or his <br />designee wilf answer the grievance in writing within seven (7) working days foliowing <br />compietion of the Step 3 e(iscussions. The affected employee shal( be required to attend <br />the aforementioned meeting, <br />AlI Sfiep 2 or 3 meefings under the grievance procedure shali be scheduled <br />during the fast forty-fiive (45) minutes of fhe work day unfess otherwise mutualfy agreed <br />to by fhe parties. <br />St_ ep 4: If the grievance is not satisfactorily settled at Sfiep 3, the Union may, within (30) <br />calendar days after receipt of the Step 3 answer submit fhe mafter to arbitration. The <br />Union shall notify the City of its intent to appeal fhe grievance to arbitratian in writing. <br />Promptly fhereafter, rspresentatives of fhe City and the Union shall meet far the purpose <br />af, attempting to select an arbitrator by agreernent. If fhey cannot so agree, the Union <br />shal( send written notice of its inient to arbitrate the grievance to the Federal Mediation <br />and Conciliation Services. If fhe Union does not send this notice to the Federal <br />Mediafion and Conciliafion Services within ninety (90) days of notifying the Cify ofi ifs <br />intent to arbitrate a grievance, then the grievance shal( be considered withdrawn. The <br />Federal Nlediation and Concifiafion Services shali submit a panef of seven (7) arbitrators <br />to each party and the arbitrator shafl then be chosen in accordance wifh Association's <br />then appiicable rules. ? he fees and expenses of the Arbitrafor, fhe meeting room and <br />stenographic service shall be borne by the losing party. The affected employee shall be <br />required fo attend the aforementioned meefing. Secfiian 3, !n fhe event a grievance goes to arbitrafion, the Arbitrafor shall have jurisdiction <br /> <br />anly over disputes arising out of grievances and the Arbitrator shall have no authority to add to, <br />subtract from, or madify in any way the provisions of this Agreement.
