(b) Hours of vacation which the employee did not work but for which he received <br />pay pursuant to Articfe 21 of this Agreement. <br />(c) Hours of jury duty or witness duty which the employee did not work for which he <br />received pay pursuant to Article 26 of this Agreement. There shall be no <br />pyramiding of overtime. <br />Section 7. If a fime ciock is to be used for a department, all hourfy employees shall be required <br />to clock in and clock out at the beginning and end of each shift. Any employee clocking in fate <br />wiil be docked to the nearest tenth of an hour. Any emp(oyee working overtime the approval of <br />supervision shali be paid overtime to the nexf tanth of an hour. <br />ART6Cl.E 19 - DESTRiBEJTION OF QVER3IME <br />Secfiion 1. The City shail ba the sole judge of the necessity of overtime. AN overtime shali be <br />voluntary and an employee shaf( have the right to refuse any overtime assignment except for <br />emergencies. An "emergency' is defined as any impairment fo City services or operations which <br />cannot be delayed until the beginning of the next regular work day, fn non-emergency <br />situations, the City may require the least senior qua(ified empioyees in the ciassificatian who <br />are available, fo perForm the overtime work. <br />Section 2. The City shail endeavor, insofar as it may be pracficable, to make a generaliy <br />equitable distribution of overtime work among employees within a classification and department <br />who are capable af performing the avaifable work satisfactorily. Employees who are offered <br />avertime and for any reason refuse or fail ta work shall be crediied with the avertime as if they <br />had worked, for the purpose of overtime distributioR. An empbyee who works overtime will be <br />credited oniy with the number of hours he actuaiiy worked. An employee who shouid have been <br />calied up fior overtime, but was irmissed, shall have deducted from his equa(ization the tofal <br />number of hours that were worked on that overtime call. fn the event that a sufficient nurnber of <br />employees are not available within the c}assificaiion for the overtime assignment, qualified <br />empioyees from a different ciassificafion and/or department shall be offered the overtime work <br />13
