ARTlCLE 3 NON DlSCRIMlNATION <br />Section 1. Bath the City and the Union recognize their respecfive responsibilities under the <br />federal and state civil rights laws, fair employment practice acts and ofher similar constitutional <br />and statutory requirements. Therefore, both the City and fhe Union hereby reaffirm their <br />commitments, legal and mora(, no# to discriminate in any manner relafing to empioyment on the <br />basis of race, color, creed, nationai origin, sex, age, handicap/disabi(ity or any other invidious <br />reasan. <br />Secfion 2. The City recognizes the rights of a11 empioyees and applicants for employmenf to be <br />free to join the Union and participate in lawful, concerted Union activities. Therefore, the City <br />agrees that there shall be no discrimination, interference, restraint, coercion, or reprisal by the <br />City against any employee or any applicant for emp(oyment because of Union membership or <br />because of any lawful activity in an official capacity on behalf of the Union. The Union <br />recognizes the right of a!i employees and all appficants for employment to be free to join or not <br />to join the Union. <br />Section 3. Ail of the employees of the City within the bargaining unit shail receive equitable <br />treatment and share in any ail benefiits provided herein. <br />ARTlCLE 4.GHECK-QFF/F.AIRSHARE FEE <br />Section 1. The City shall deduct the initia.tion fee and regular montnfy dues from the pay of <br />emplayees covered by this Agreemznt upon receipt from the Union of individuaf written <br />authorization cards voluntarily executed by an employee for that purpose and bearing his <br />signature, provided that any employee shall have the right to revake such authorization during <br />any thirty (30) to forty-five (45) day period prior to the expiration of any calfective bargaining <br />agreement by giving written notice to the union with proof of service <br />Section 2. Deducfions under this A,rticle 4 shall be made during the second pay period of each <br />month, but if an employee's pay for fhat period is insufficienf to cover Union dues, fhe <br />Ciiy vvill make a deduction from the pay earned during the next period or a subsequent period. <br />2
