The inclusion of all related and accessory items such as, but not limited to, adjustment <br />or replacement of sanitary manholes, monument boxes, water valves, utility curb <br />boxes or miscellaneous structures. Also included shall be curb ramps, driveway apron <br />replacement, treelawn restoration, or other accessory items as directed. <br />The Proposal shall include the following items in the Scope of Services: <br />1. General Conditions: <br />(a) Work shall not be subcontracted without prior consent of the City in writing. <br />(b) Additional billable services shall not be performed without prior consent of the <br />City in writing. <br />(c) Key personnel to perform services shall be listed in the proposal. <br />(d) The consultant shall indemnify and hold the City harmless from all losses and <br />damages resulting from the Consultant's failure to meet the standard of care for <br />services at the level customary for competent and prudent engineers performing <br />such services. The Consultant shall be responsible for the professional quality, <br />technical accuracy, timely completion, and coordination of all services. <br />(e) The scope of services may be amended by mutual agreement. <br />(f) If a dispute axises between the Consultant and the City regarding the contract for <br />services, the City and the consultant shall negotiate in an attempt to resolve the <br />dispute. Should negotiations be unsuccessful, a mutually acceptable third party <br />may be engaged to mediate the dispute, with expenses equally shared between the <br />City and the Consultant. <br />2. Surveying Services: <br />(a) Research and procure all appropriate records and perform all surveys to establish <br />the horizontal and vertical control alignment for the proposed improvements. <br />(b) Obtain all pertinent information regarding the present conditions at the site with <br />respect to existing iiistallation or other conditions relevant to the design.
