arbitrators to each party and the arbitrator shall then be chosen in accardance with the <br />Association's then applicable rules. The fees and expenses of the arbi#rator, the meetng room <br />and stenographic service shall be bome by the losing party. The affected employee shall be <br />required to attend the aforementioned meeting. <br />Section 3. in the event a gdevance goes to arbitration, the arbitratorshall have jurisdiction <br />only over disputes arising out ofi grievances and the arbitrator shatl have no autharity to add to, <br />subtract from or modify in any way, the provisions of this Agreement. The arbitration will be <br />conducted under the voluntary labor arbitratian rules of the American Arbitration Association. <br />Section 4. All awards of the arbi#rator and ali pre-arbitration gdevance settlements reached <br />by the Union and the City shall be final, binding, and conclusive on the City, the Union, and the <br />employees. A gdevance mey be withdrawn without prejudice by the Union at any iime during <br />Steps 1, 2, 3 or 4 of the gdevance proceclure. All monies agreed to be due in a prearbitration <br />settlement ar following an arbitration award shall be paid to the employee on the payday fior the <br />pay period following the date of the agreement as to the exact amount owed. Such sum shall be <br />issued in a separate payroll check. <br />Section 5. Na gdevance will be processed unless it is fiied within the time limit established <br />for filing grievances. If a gdevance is not appealed by the Union to the next higher step within the <br />time limits established in the gdevance procedure, the gdevance will be deemed to be settled on <br />the basis of the City's last answer. If the City fails to answer a grievance within the time limits, the <br />gdevance will automatically be appeaied to the third step in the grievance procedure. <br />Section 6. The time limits set forth in the gdevance procedure shall, uniess extended by <br />mutual written agreement of the City and the Unian, be binding on both parties.
